[Resolved]  Hyundai Car Dealer : Pramukh Car Riders (Formerly Jaybharat) — Not Honouring Transaction, Taken Full Payment but Not Delivering Car.

Dear Sir,
My Name is Rajesh Solanki and I had the unfortunate circumstance of booking a car from the above dealer.
*On 12/12/12, I called up the above dealers no and one Mr Jayesh from Pramukh Car Riders, explained the offer on i10 for 12/12/12 on phone. For old car he gave the line to another representative, Mr Salim, who after taking verbal discription, informed me the price would be the scrap value of 10000+bonus of rs 30000, totalling rs 40000 & there was no need for pre inspection.
I visited the swowroom at 9pm (as I was told the offer was only for this day) & paid the chq of rs 551198 in full, for which I was given a receipt, which clearly mentioned the price of the old car.
I further paid an amt of 4500 for remote lock. Next day their representative came to my place, inspected the original registration & insurance papers & took my car and the papers away with him.
* On 14/12/12, I called up to ask if it was possible to change the color of the car from White to Silver. After checking, I was informed that it could be done, but I would have to pay Rs 4249/ extra, and give a letter mentioning the same. Their person came to my office and collected the cheque and the letter.
* On 18/12/12, I received the call in afternoon that the car would be delivered by this friday as it had gone for cng fitment.
I received another call in evening, & this time a lady informed me that, since the old car was on my company's name I would NOT be given exchange bonus. When told that I should have been told this when they took the payment or when their executive CHECKED THE PAPERS & took the car, she just kept on arguing and repeating that I would have to pay extra.
Frustrated I told her either deliver the new car as agreed or to send my old car back & refund my money.
She said it was not possible to return the car or refund the money.
Does the world renowned Hyundai corporation condone such unethical business practice of its associates ?
I FEEL CHEATED BY THIS DEALER, KINDLY ADVISE WHAT SHOULD I DO.

Dear Sir,

We are in receipt of your mail dated 19.12.2012 & 20.12.2012 sent to Hyundai and noted the contents thereof.

At the time of booking, it was informed by you that the car to be exchanged is in your name, i.e. name of purchaser,
hence the exchange bonus was offered to you. But when we received RC book of your Fiat siena car, we observed that,
the car is in the name of "Zaveri Kapoorchand Lalchand" and not in your name (as informed by you at the time of booking)
hence, we regret to inform you about our inability of assistance to you for Exchange bonus.

Now, you are requested to kindly make the balance payment of Rs. 30,000/- to enable us to complete the procedure of CNG fitment & deliver your car with no further delay.

MY REPLY TO THE ABOVE MAIL:::

Thank you for your reply.
There are several wrong statements in your reply, intentional or otherwise, I am at a loss to understand. Let me clarify one last time.

*At the time of booking the vehicle there was NO MENTION of ownership of the old car, in fact the lady who attended just referred to the working calculation of one Mr Jayesh, and the cheque was issued for the full amount, you can verify this from the lady herself. The price of the new and old car was decided on the Phone itself. Your representative, one Mr salim said there was no need to inspect the old car as he was taking it at scrap value, and he will come a day later and collect the vehicle. This was confirmed by Mr Jayesh, who advised me to make the payment on the very day (12/12/12) as the scheme was ending that day and I should give the papers of the old vehicle's to Mr Salim when he comes to my place. STILL NO MENTION OF OWNERSHIP ISSUE. I am sure you must be having recording of the same, as all major corporations do, kindly refer to it to verify EVEN IF ONCE THIS SUBJECT WAS MENTIONED.

*On 13/12/12, a day later when your representative, Mr Salim, came to my place, I handed him all the original papers to him, which he INSPECTED and THEN he took my car with him. WHAT STOPPED YOU PEOPLE FROM POINTING TO THE OWNERSHIP ISSUE RIGHT THERE AND STOPPING THE AGREED TRANSACTION ? Instead you go ahead and deposit the cheque, that in itself prooves that you CONFIRMED the transaction, and PROVES YOUR LIE when you write, I quote..
"But when we received RC book of
your Fiat siena car, we observed
that, the car is in the name of
"Zaveri Kapoorchand Lalchand"
and not in your name (as informed by you at the time of booking)" unquote.
Remember you received the RC book on 13th dec 2012.

There's more..
* On 14/12/12, I called up to ask if it was possible to change the color of the car from White to Silver. Your person came to my office and collected the cheque and the letter. You deposited the Cheque. NOW ITS TWO DAYS SINCE YOU HAVE THE CAR PAPERS, BUT STILL YOU CHOOSE NOT TO SAY ANYTHING REGARDING THE OWNERSHIP ISSUE. IN FACT I WAS ASSURED THE VEHICLE WOULD BE DELIVERED BY TUESDAY, 18TH DEC.

*There's More..
On 18/12/12 I Received a call in AFTERNOON from the same lady who attended to me earlier, who informed me that the New vehicle will be delivered by Friday 21st Dec. As CNG has to be fitted.
Again in evening the same lady calls me up, and this time she alleges that I will have to pay more if I wanted the new vehicle, as she was unable to give the exchange bonus for the old car. I told her everything I mentioned above. Still she kept on repeating the same. Frustrated I told her if you can't go ahead with the agreed transaction, kindly refund my monies and return my old car. She said NEITHER CAN WE RETURN THE OLD CAR, NOR CAN WE REFUND THE MONEY.

*ON 19th Dec, I received a call from the same lady, repeating the same thing, I gave her the same reply regarding my stand, adding that if they continued in the same unethical way, I would be forced to take legal recourse. She assured me that she will contact the management and resolve the issue.

*Today I receive this mail, making all sorts of false allegations. Looking at the tone of your mail, I feel it will be futile to confront you people with facts. I request you one last time, to honor your commitment and not spoil the joy of my posessing the new car, which you have already done to a certain extent. I hope better sense will prevail, if not for your own reputation, then atleast for Hyundai Corporation, a brand of global repute.

I CALLED THEIR SHOWROOM TWO MORE TIMES, THE LADY WHO HAD TAKEN THE PAYMENT EARLIER, NAMED NETHRA, WAS TOO BUSY. ASKED TO BE PUT ON TO SOMEONE SENIOR I WAS KEPT ON PERPETUAL HOLD. NEITHER THEY ARE RESPONDING ON PHONE NOR HAVE THEY REPLIED TO MY MAIL AFTER THREE DAYS. THEY HAVE TAKEN ALL THE MONIES, MY OLD VEHICLE, AND NOW BLACKMAILING ME TO PAY 30000/ EXTRA IF I WANT THE DELIVERY.KINDLY ADVISE HOW DO I GET JUSTICE. THANK YOU.

Next. — Delivery comitment not being honoured.

I have on 24th April booked a split ac 1.5 T model AS18NA Samsung with M/s Next at their Kothrud outlet. The delivery of the same was to be on 29.04.08. Now they say they cannot deliver the same as it is out of stock with the company and what they had reserved for me was delivered to someone else. Now they sayI should upgrade to the 1.6 T model and pay a price difference. When they are not in a position to honour their commitment it is they who should pay for it not me. Booking Receipt No 1691.
