I have negotiated a Laptop (Compaq model C 501) from M/S ANS computers, Shop no. 258, First floor, HUDA Market sector 7, Faridabad on 5th June 2007 under finance scheme. After assurance of dealer that he will provide finance facility through Bajaj Alliange within a day, I have given all the documents related to finance process along with cheque of Rs 10500/ as a down payment and eight cheques of Rs 2426 as an EMI. After submission of all these documents, dealer has assured me that he will deliver above laptop on tomorrow (06th June).
Next day when I have make a call for confirmation of delivery, dealer has told me that my finance could not approved due to negative verification of my local residence proof (which is totally false as no body visited my residence for verification) therefore, I refuse to purchase above laptop and ask dealer to return my all the papers and cheques but dealer was not agree to return my papers. Thus I stop the payment of above cheque through phone banking and purchase same make laptop from another dealer (M/S Computer Solution) under finance scheme through CITI Bank and I am paying EMI from last three months continiously.
After one month dealer (M/S ANS Computers) has send a legal notice through his advocate for payment of above cheque on 4th July. Subsequently I have discussed with my advocate and send my reply on 9th July that if you have not deliver me the laptop why I will pay you the above said amount and why you want to extort money from me.
Again dealer has registered a complaint to CJM court under section 138/141/142 RW 420 IPC. Honorary court has sent an accused notice for PESHI on 27th Nov.
Due to all above exercise I am under deep mental pressure and my study is also suffering as apart from my job I am also doing B. Tech from BITS (Pilani).
Kindly help me to resolve this problem.
