I had purchased a flat from ATS Infrastructure Limited sometimes in 2005-6 and had made an upfront payment of Rs44.50 lacs. The scheduled delivery of the flat was in 2008, however, despite several attempts and enquiries I was unable to get an exact time of delivery without satisfactory explantion on the delay. In the original sale of agreement, a clause of interest payment in case of delayed delivery had been mentioned.
I had been writing several mails to them and in August 2010 got an offer without exact flat number alloted or any details of balance payment. I had been requesting them for these including the interest that shall be payable to me. Till recently I had been getting a response - we will get back to you.
Now I have received a mail from them on what is the balance payable by me for maintenance charges etc. In addition the interest offered by them is 6% and that too not till recent but only till August 2010.
I do not agree to this since
1) the delay is from there side and they haven't even given me the possession yet.
2) the delay has been unreasonable more than 2 years and an interest of 6% is unreasonable as this is not market related as no funds are available at this rate.
I look forward for a solution to the above situation.
