I had taken a unlimited SMS Pack for Rs. 99/- from Bharti Airtel Limited, Mumbai. It was told that it had a limit of 6000 SMS post which the SMS facility would be blocked, which is fair enough.
Bharti blocked my facility in April'12, for going above 6000 SMS, to my surprise however the bill for that month also contained SMS charges for SMSs that were exceeded by 200 per day.
I referred to their Appellate authority the notification from TRAI (reference: TRAI Notification F.No.341-3.2011-CA (QoS)), where it is explicitly mentioned that Pt 3.
"3. And whereas clause (k) of sub-regulation (2) of regulation 20 of the regulations provides that no Access Provider shall provide to any person, other than a telemarketer registered with the Authority, any tariff plan or SMS package in any form such as special recharge voucher, student pack, seasonal pack etc. permitting sending of more than one hundred SMS per day per SIM except on ‘blackout days’ and additional days as may be specified by the Authority by direction issued from time to time and all such SMS packages already provided to any such person shall not be renewed after their expiry;"- Only Exception being to telemarketers registered.
The appellate authority responded back saying, TRAI has directed in their notification dated Nov 1'2011, that this is not for postpaid subscribers and they are unable to share the notification with me. I cant understand, if TRAI notifications are public document, why cant they show me a rule which says the same.
I have also written to the Greivance dept of Government of India, awaiting their response.
Help me, if can !! Thanks. Was this information helpful? |
