GM Infinite — Non-Refund of booking Amount

I had booked a flat for booking amount of Rs. 1 lakh with GM Infinite builders for their E-city town project on 1st December 2014. The builder did not give all the property documents upon booking and only provided the booking form and flat allotment letter. I was to apply for my company PF loan which I failed to withdraw due to this non-providing of essential documents. I had asked for refund of booking amount after that, but builder said they will not return single penny and forfeited the entire amount. I think it is illegal for any builder to forfeit entire booking amount. Please help. I have got necessary e-mail communications in support of my case.
