When an attorney is unable to fend for himself in court, how can a client expect him to win for them? Such a question is proper with Scott McMillan San Diego Attorney who lost multiple lawsuits where he represented himself.
La Mesa attorney Scott McMillan lost his lawsuit seeking to remove a report about his involvement with child molestation with a childhood friend and client,
San Diego attorney Scott McMillan, The McMillan Law Firm La Mesa, California lost three lawsuits to remove a report naming him as a suspect in child molestation. A true friend of Scott McMillan, was arrested for child molestation. A report named Scott McMillan San Diego attorney as a suspect. The report was filed as an exhibit in San Diego Superior Court Case No.[protected]. I attached a copy of it to this post.
It is concerning to know a friend of Scott McMillan, Kenneth Bourke, was arrested for child molestation, Most people would cut ties with people who were arrested for such horrific conduct. However, Scott McMillan had no issue with representing him in Bourke v. Castanda, 4th DCA, Case No. D024992 where the child molester requested attorney fees for him:
“Plaintiff requests reversal of Anti-Strike Ruling, and denial of Defendant’s unjustified attorney fee award of $19, 500. (It includes inflated “training costs” for unlicensed new interns, which judge was no discretion to award) and requests order for reimbursement of costs plus attorney fees for legal support assistance from associated supporting legal counsel Attorney Shaun McMillan, Esq., Attorney Scott McMillan, Esq. Attorney Jim McMillan, Esq, $10, 000 each, to McMillan Law LLP for legal assistance, counsel and services...”
Scott McMillan is characterized as a vexatious litigant. In McMillan v. Weathersby (9th Cir. 2002) 31 F.App'x 371, 374. [Appeal from the United States District Court for the Southern District of California. D.C. No. 95-CV-3934TW(LAB). Thomas J. Whelan, District Judge, Presiding.] the court said, “None of the three main episodes that McMillan offers supports granting a mistrial. McMillan first asserts that defense counsel violated the court's in limine ruling barring reference to McMillan as a "vexatious litigant" by referring to McMillan's other lawsuits in his opening statement.”
I really hope this serves as a warning to people who intend to hire an attorney. Scrutinize the background of the attorney. Potential jurors may Google your attorney and find conduct like this and not look upon your case favorably. Although a juror is not supposed to look at information outside of a trial, the fact remains everyone has a phone and can Google anything to answer a question.
