Hello, my name is Yoginder Yadav. In Dec 2017, I was approached by Mr. Vinod and Mr Gaurav on behalf of Avalon projects to invest in Avalon Royal Park. I was assured that it was a subvention scheme with buy-back plan where the builder will pay all the EMIs till possession and will buy back the flat. I was allotted Flat no 1402 in Tower B1 of Avalon Royal Park project. Mr Vinod arranged Home loan from ICICI bank and all the amount was disbursed to the builder at once.
For around 18-20 months the builder sent EMI amount to my account but after that the builder stopped paying the EMIs. Due to my low economic condition I couldn't pay the EMIs myself. The bank started pressurising me. I went to meet the builder and review the project but found that the builder had stopped construction of the project with no intention to complete the project.
Now the bank has filed a case against me in DRT and when I reached out to the sales manager of the builder (Avalon projects) he told me that RERA has taken over the project.
I need help to get the amount back from the builder so that I can repay the loan amount. In a similar case with the same builder (Avalon[protected] PRABHSHARAN SINGH VS. AVALON) the honourable RERA court directed the builder (Avalon) to refund all the amount back to the buyer with 9.5% interest per annum.
