Bmw — BMW X5 drive Shaft failure

Dear team,

I have purchased a used BMW X5 3d xdrive 2015 model. So far I've driven 94000kms and unfortunately while driving, all of sudden the propeller shaft/drive shaft front broken and damaged the gearbox. How could it happen for 6 year old vehicle. I also own xuv[protected], Skoda Octavia, (2004)&(2015) Hyundai santro(2000) models. I've never faced such issues. Moreover my father is a fleet owner, we have never faced such issue in 15yrs old trucks too. Later I came to know BMW recalls X5 and X6 for driveshaft failure. But they never replaced in my vehicle. Why? Now who is responsible for the issue? It's cost around 14lacs. What else you do if something would have happened to the passengers? Also I'm a design engineer, working in FCA, also worked in Daimler India. So I identified the cause that leads to damage. Water drops from AC drain pipe is straight ahead to universal joint. Is this a way to design? Also there is no clearance maintained between gearbox housing and drive Shaft. Now who's responsible for this mistake? Who would bare this cost?
