JAIPUR: Police on Thursday arrested the director of city-based Asia Pacific Institute of Management, Jaipur, Kailash Shankar Gautam (40), on charges of duping 86 students of Rs 1.5 crore. The students were pursuing a post-graduate diploma in management (PGDM) course. Gautam was sent to 15-day judicial custody after he was produced in court on Thursday afternoon.

Gautam was running the PGDM course from Asia Pacific Institute of Management in the city without getting approval from the All India Council for Technical Education (AICTE).

According to the police report lodged by Rohit Dixit of Aligarh and four other students, Gautam advertised about the admission to a two-year PGDM course at Asia Institute of Pacific Management in local newspapers. The brochure issued by institute said the course was approved by AICTE. Eighty-six students took admission and the course started in July 2008. They paid Rs 90,000 as annual fee and other expenses.

However, during the middle of the course, they came to know that the course was not approved by (AICTE) and that they might land jobless even after completing the course. When the students approached Gautam, he assured them about the approval but the students were not satisfied. They reported the matter to the AICTE office in Delhi. In September, they all heard from AICTE, which advised that they ensure AICTE approval of the programme before advancing further.

Following the notice from AICTE, a group of students filed an application under the right to information (RTI) Act to enquire about the approval of the course from AICTE. The reply brought more misery as it said the course was not approved and neither was any such case pending with the body.

The students then demanded the director refund the fees but he refused and claimed that approval was pending.

Sindhi Camp police said that cops have registered a case of fraud against Gautam, who was arrested and produced before the court. During preliminary interrogation, Gautam maintained that he had applied for AICTE approval, which was still pending. The police are investigating the matter further.

Dear Sirs
This is to bring to the Notice of general public that the news reported is partial in facts.

The above issue was raised and the incumbtant institution / director got affected not due to the wrong intentions or doings on their behalf but because of collaus attitude of authorities overseeing higher education i.e AICTE. To correct the facts we would like to give the facts as below:
1. The incumbtant institute was running MBA program approved by AICTE, affiliated to University of Rajasthan and later affiliated to Rajasthan Technical University since 1999. (AICTE File No.RJ-05/mba-et/2000) in name of The Institute of Certified Management Accountants of India.
2. However, due to UGC regulation the AICTE sent us letter No.NWRO/2843/14.9.2007 to change the name of the Institute since it would not allow the use of name "India" in the name of Institute, changing our name from The Institute of Certified Management Accountants of India to Asia Pacific Institute of Management.
3. We have been inspected by AICTE Inspection team for PGDM Program for Session 2008-09 for intake of 90 seats. The inspection report recommended 90 seats for PGDM program, since we had applied for change of nomenclature from MBA-FT to PGDM-FT from session 2008-09.
3. We applied to AICTE vide letter dated 8th April, 2008 hand delivery (acknowledged by AICTE, Chandigarh. for change of name and also for change of nomenclature from MBA to PGDM with a fee of Rs.40000/- vide DDNo.240816 dated 3.4.2008 drawn on Punjab National Bank. acknowledged vide letter No.NWRO/1410 dated 8/4/2008.
2. Our contention was accepted by AICTE and vide letter FNo.RJ-05/MBA-ET/2000 dated July, 26, 2008 asking us for NOC from State Government and NOC from affiliating University (RTU). In view of this letter Rajasthan Technical University, Kota issued NOC dated 18.11.2008 for change of nomenclature MBA to PGDM and name of the Institute fro the session 2008-09 (vide letter no. FI/Acad/2008/536 dated 18.11.2009.
3. AFTER RECEIPT OF THE NOC, the Bureau (M&T) F.No.05/MBA-ET/2000 dated 15/12/2008 put the note of the record of our file which reads as follows: (since the scanned copy cannot be loaded on the net)

Now above institution has submitted proof of compliance report submission at NWRO (on 14/-9-2007 and 8.4.2008) for change of Name at F/C alongwith NOCE from Rajasthan Tech. University, Kota at F/D for conversion MBA TO PGDM course.

Based on the above, documentary evidence - as earlier attested Notarise copy submitted and now NOC from University submitted by the Institution, council can allow for change of the name -
(A) Old name - The Inst. of Certifed Mgt. Accountants of India, D-187, Bhrigu Marg, Bani Park, Kantichandra Road, Jaipur-302016 to New Name - Asia Pacific Institute of Management, D-187, bhrigu Marg, bani Park, Kanti chandra road, Jaipur 302016 and
(B) for conversion MBA to PGDM with same existing intake 90 to the institute, the case may be forwarded to the Hearing committee for detailed couurse structure with admission and evaluuation guidelines and the same institute may be called for hearing.

In the above circumstance, how can the institute be held responsible for the fault.

Further to bring to the notice of the Public that the Institute had REFUNDED ALL THE MONIES TO ALMOST ALL STUDENTS, with a few exceptions who chose to pursue the case with Consumer Court. With this explaination we again call a few students to come and settle their payments so that the matte could be ended. Still if they chose to go by the Consumer Court Order, we shall respect the judgement of the court. However its better the solve the matter mutually as also promoted by courts in India.
