Dear Sir
Greetings to you from Exemplarr.
Background:
VSNL (service provider) have been providing bandwidth solutions services to Exemplarr– Formerly known as RR InfoTech (Client).
Under the service terms we had agreed to use your Data Center to transfer our data between our clients and Exemplarr, wherein we would co-locate one of our servers at your premises for this service.
The remuneration that was to be paid by Exemplarr for this service was agreed as follows:
A monthly data transfer charge of Rs.35000/- would be paid to you for the download & upload of data to the extent of 100 GB.
A server space rent of an amount of Rs.5000/- per month would also be paid to you.
Current Situation:
We are in receipt of your letter dated 30th July 2009 for a claim amount of Rs.15, 75,126/-.
Exemplarr’s point of View.
With regard to your claim for Rs15, 75,126/-, we would like to bring to your kind notice the following points. We have received the claim for the outstanding amount from you only on 30th July 2009. for an amount of Rs.15,75,126/- with the breakup as detailed in the Annexure Attached : (Annexure -1)
· You have charged us an amount of Rs.726, 882/- for the IDC-DNS Hosting.
– In this regard we would like to bring to your kind attention,
– that we have not utilized this service till date.
– you have not provided any proofs to claim on our utilization of this service.
– we have not received any monthly / yearly bills for this particular service till date.
– you have claimed the charges for the period of three years from April 2005 till November 2008 in a single statement. We infact formed a team to reconcile the billing issues with VSNL and visited your office couple of times to meet your Accounts team. But lots of our queries were unanswered and no clarifications provided as to the billing terms for this service. These aspects clearly reflect that this amount was not chargeable as per the original service terms between us.
As we have not utilized this service, we don’t think it is right on your part to claim this amount from us. Hence this amount is not payable by us.
· Incremental Bandwidth usage :
As per our agreement we had agreed to use the bandwidth for a monthly fee to the extent of 100 GB. Any incremental usage would be charged extra. We would like to bring to your kind attention that we have not received any billing intimation or claim from you on a monthly basis for the extra usage of bandwidth for the last two years. Based on this we presumed that we have not utilized any extra bandwidth. Now all of a sudden you come with a claim of Rs. 540,182 for the extra bandwidth utilized from 1st March 2007 till 30th April 2009. This was received by us only on 30th July 2009. I am sure that you will accept our point that all claims that are payable are to be accounted in the concerned accounting year itself. Now you have brought this to our notice after all our provisions in our books are closed.
In this instance, we would also like to bring to your kind notice that there was a disconnection of the Datacenter services for 2 days on 23rd & 24th June 2009, which had adversely affected our operations. On checking with your team, we were initially apprised that the disconnection was due to the pending payment. On further investigation, we understood that the disconnection was not due to the pending payment, and we were misguided by your channel partner as well as VSNL accounts team. The same channel partner refused to support us when the line was disconnected and never bothered to answer our calls and we were forced to co-ordinate with VSNL billing and technical team directly for the reactivation of the link, but our active circuit was disconnected in place of an inactive circuit. This caused a crisis situation for us with our customers as there were huge chunk of data that were to be processed on TOP priority, which ultimately resulted in a huge loss to us. We were penalized in terms of the penalty clause for delayed deliveries to the tune of Rs10 lakhs. Please do let us know as to why we should not claim this loss from you.
We had issued a purchase order for an amount of Rs. 248000/- towards providing us the Internet services through OFC link, but this has not been done till date. But you have provided us with an alternate solution through wireless. This option was with a condition from your end that this would be replaced with the OFC link in 2 months time. This has not happened till date. We are now in receipt of your invoices charging us for a higher amount of Rs.52, 000/- per month, which was paid under protest.
We have also issued a purchase order dated 18.08.2008 for the last mile connectivity service to our co-located server and have also effected the necessary payments for the same. We were not linked with this last mile connectivity till date. After couple of months of issue of the PO and the payment, we were given to understand that this was not feasible. The amount for the same was adjusted in our bills after 6 months. Here we would like to ask you as to how you could sell the service to us even without checking the basic feasibility study of the site.
We would like to thank you for all the services that you have given till date.
Under all these circumstances, we have taken a call to put in place alternate services from your competitors and also terminate all your services that you have been providing us, with immediate effect.

So many rejections from PF office due to careless form filling and fail to attach necessity documents from employer.
The old employees who they expecting their PF amount for future commitment, definitely it won reach you with in the calculated period. Even months, years may gone.
It happens to me and so many colleagues who they resigned with me in before and after. Its took more than one year to settle my PF amount after many struggles.
