[Resolved]  Lodha Bellissimo — Delayed Possession, Non Payment of Interest for delay, Extra Payment Demand towards Vat & Deficiency in Quality of Material Used

Dear Sir,
As mentioned in the subject matter, I would like to lodge a complaint towards the above Company who are developers of Lodha Bellissimo Project at Mahalaxmi Mumbai. I had booked 2 apartments in the B tower of the said buildings on 40th & 41st floors Flat Nos. 4001 & 4101. and the agreement was executed on 29th June 2009. As per the agreement the possession of the flat was to be given by March 2010. In case of delay the developer had seeked 6 months grace time i.e. upto Sept. 2010; beyond which if their is delay in handing over of possession; then the developer would be liable to pay interest @ 12% p.a till the date of possession is handed over to the customer. I have received a statement from the developers to make certain payments & take over the possession, in which they are not showing any calculations and amt. payable by the developers to me towards this interest amt. Further the statement is showing 5% amt. payable towards Vat which is not applicable at the moment & for which the builder requires to collect the money & put the same in F.D. According to us there is no mention of Vat at the time of booking of Apartment and this amount cannot be thrusted on the customers by the developers. There are other issues on the quality of material shown by the builder as per their sample flat & what has been actually used in the apartments; say it in flooring, or bathroom/kitchen fittings or quality of doors used all of them are inferior than what was promised.
