I have Taken the Zest Holiday Membership on Sep 2009 and i have paid a Down Payment of 7,000 + and Monthly I'm Paying an EMI of Rs. 3500 + through my Credit Card. So far i have utilized 2 Nights Holiday on one of their Resort against my eligible 12 Nights (as of now).
During the Sales Process the Executive Promised me that i will be eligible for Holidays during a Particular Season (based on the plan i have choosed) and informed that i can avail the holiday any day of the week during this eligible period (Week day or Ween End's). But later, it was informed by them that i can avail only one Week End Holiday and all other holidays i should plan only for a week day.
They Promote by Saying that it is "Week End Gateway".
Since there was no Proper Service to My Requests as mentioned below, i have intiated for cancellation process, where i requested them for cancelling the membership and to re-fund the balance amount after doing necessary deductions based on my usage of their services so far.
But, i got shocked with there feedback, that there is no Re-fund paid for cancellation and they also mentioned that it is shared in their initial agreement (which i'm yet to refer to ).
Pl. Let me know if these kind of agreements are valid? where i have entered into the membership only for utilizing the services offered by the organization. But, when the required service was offered to me, don't i have the right to cancel the same and to get refunds for the un-unitilized amount. It is after all my hard earned money.
I request your guidence in resolving this issue, benefitting both the parties.
Reasons for Cancellation (As explained during discussion, except point no. 5):
1. No Response received against my Credit Card No. Change Request Initiated on 31st Jan 2011 (Pl. Ref. Below mail)
2. No Proper response received against my holiday reservation booking request initiated on 1st Jan 2011 (Pl. refer your internal communication log) against my membership
3. No Proper response received against my holiday reservation booking request initiated on 1st Jan 2011 against the Holiday Voucher offered to be by a 3rd Party Vendor
4. Yet to Receive the Holiday Voucher offered by a 3rd Party Vendor which was initiated on 30th Jan 2011 with one of your executive mentioned in the letter provide by the 3rd Party Vendor.
5. No Response received for my request for unchanged “AMC” Value which was initiated around Sep 2010.
