Respected Sir,
In connection to the above mentioned Subject and Reference, I, Nabarun Dutta wish to inform you that I have a Life Insurance policy ( Referred above ) in MAX NEW YORK LIFE INSURANCE CO.LTD.
In a letter dated 07/07/2008, I informed to the chairman of MAX NEW YORK LIFE INSURANCE CO.LTD that I want to stop my payment and want to return all of my invested money (Two years premium).But I get the reply by the letters on 19/7/08 and 21/7/08 from MAX NEW YORK LIFE INSURANCE CO.LTD that it is not possible to return my money.After some days on 30/7/08 GTMS,Gariahat agent- Shibani Deb ( Mob No:[protected]) called me in my mobile (my mobile no: [protected]) at 6-42Pm and told me that if I give my third premium to the above mentioned policy and stop after that , then I will get back my invested money without any bonus after completion of 11(eleven) years ( i.e. after completion of my policy maturity period).
After that I had written to MAX NEW YORK LIFE INSURANCE CO.LTD on 02/08/08 that I am ready to give my third premium if Shibani Deb’s information is true.
But unfortunately I received a letter from MAX NEW YORK LIFE INSURANCE CO.LTD, dated:- 05/08/08, informing me that my policy currently is in lapsed status and also informing me for further assistance to contact in the following no. [protected].
Then I asked to [protected] on 12/08/08 on 7-15Pm about my policy status and got the reply that :- If I stop my payment after submission of third premium, then I will get only 30% of my invested money and will not get the full amount of my invested money (i.e. Two years premium after completion of 11(eleven) years ( i.e. after completion of my policy maturity period).
After that a call coming from MAX NEW YORK LIFE INSURANCE CO.LTD[protected] on 26/08/08 at 3-30Pm informed me that Shibani Deb is not the direct employee of MAX NEW YORK LIFE INSURANCE CO.LTD and also informed me that I will not get my invested money in full amount if I stop my payment after 3 years, then I get only 30% of my invested money.
But I was really surprised that on 28/08/08 at 6-30Pm Shibani Deb again told me strongly and confidently from her mobile ([protected]) to my mobile ([protected]) that I must get return full amount of my invested money without any bonus after completion of policy maturity period if I stop my payment after giving Third premium and she also told me that – the direct staff of MAX NEW YORK LIFE INSURANCE CO.LTD giving the informations are incorrect.
So I want to complain that there has a communication gap between direct staff of MAX NEW YORK LIFE INSURANCE CO.LTD and the agent (like GTMS,Gariahat agent- Shibani Deb).I also want to inform you that another two women of GTMS,Gariahat ( Tapati Mukherjee,Sukla Sarkar) told me at the beginning of my policy that I will get back my invested money after completion of policy maturity period if I can able to give at least three premiums of the above mentioned policy.
So, Sir, I want proper justice from you , why general people ( who are the policy holders of MAX NEW YORK LIFE INSURANCE CO.LTD) will suffer for the internal communication gap between the direct staff of MAX NEW YORK LIFE INSURANCE CO.LTD and the agents and their misguidance.
It is my humble request to you to kindly look after this matter with sympathy and show me the proper way, that I will get return my invested money ( i.e. Two years premium invested to the Policy No : - [protected], Amount of Rs. 25,540/- only )[ One Year Premium = 12,770/- and Two Year Premium =
Rs. 12,770/- X 2 =Rs. 25,540/- ] from MAX NEW YORK LIFE INSURANCE CO.LTD.

We would like to draw your attention towards the Cash value clause
mentioned in the policy contract:
Cash Value
This Policy will acquire cash value if it has been in force for at least
three years and provided all the Premiums that have fallen due have been
received. The cash value in this Policy will be thirty percent of the
Premium(s) (excluding the first year’s Premium) received.
Surrender Value
After the Policy has acquired Cash Value, you may opt to surrender this
Policy. The Surrender Value payable will be subject to the condition that
the Policy is in full force and that there are no statutory or other
restrictions to the contrary. The Surrender Value payable will be equal to
Cash Value accrued to date of surrender.
Further, we wish to inform that the maximum time allowed in order to revive
a lapsed policy is 3 years and the same is also mentioned in the policy
terms & conditions. Since the policy is lapsed for more than 3 years, we
express our inability to revive this policy
