[Resolved]  NARAYANA INSTITUTE — Non refund of maoney

I have registered name of my daughter Payal P. Prajapati for Narayana Classes being conducted in Anumala Township before the announcement of her result for XIIth Academy. Accordingly I submitted the cheque each of multiple of 78750(SBI cheque no 80464, 780465, 780466,and 780467 ) through Parents Association to M/S Narayana Institute
Results of 11th were announced in the month of April and my daughter was unable to pass the 11th class annual exam. I requested to Shri Y B Bhatt; parents association regarding this matter. He conveyed this message to you. Parents association advised me in consultation with you that your fees will be adjusted with some other new student appearing in the XIIth standard student. Accordingly Shri Sulesh Patel, Parents association member informed that I have to collect the amount from Shri R G Patel (Jignesh R. Patel). All this procedure was in consultation with representative of M/S Narayan Institute. But after a period of 20 days I was informed that such adjustment is not possible and you have to give application for refund of money. Accordingly I submitted application on 11th of June 2007 at the Guest house KAPS to representative of M/S Narayan Institute (Accountant). He assured that your full amount will be refunded within 15 days.
After elapse of 15 day, I was informed that refund will take time and will come after 3 months of time.

I was in continuous follow up with Shri Ravi kumar and was continueously assured that my entire money will be refunded

On 17/09/2007 I received a cheque (ICICI bank cheque no: 220052 dated 17/07/2007) after 1 week delay of stipulated period of amount Rs.9000 from narayan institute remaining silent about the statement of account.

My two cheques have been crossed by M/S Narayan Institute 780464 dated 16/05/2007 &780465 dated 13/06/2007 total amount I had paid is Rs 17500.

On enquiry with Shri Ravi kumar; with casual knowledge informed me that the money deducted may include service tax; Cancellation charges etc; Class fee and study material
I would like to draw your attention to the following points

a) Since my ward failed in the exam and you collected the registration well before the announcement of results, my case should not be consider as cancellation and hence no charges should be deducted for cancellation. Even at the time of registration this terms and condition was included.

b) Service tax can be levied only if I take services from Narayan institute; and if the admission is confirmed. However if the service tax has been paid I may please be given the receipt of the service tax .

c) My daughter neither had attended single hour class nor has she received any study material from M/S Narayan institute which can be verified at the study center. (This should have been verified well before processing the refund which is not taken care by the local coordinator resulting in delay of my payment)
d) The cheque date is 17/07/2007 and I am receving it on 17/09/2007 Why this delay has been incurred. Please let me know the reason for holding the cheque by M/S narayan Institute for quite a long period.

I request your kind self to submit me the following at the earliest

1. Receipt of the amount which I have deposited in the month of May is not received 2. Details of the Amount deducted by M/S Narayan institute.
3. Receipt of service tax paid for processing it for refund.


In light of the above it is requested to Refund my balance amount with panel interest at the applicable rate.

I hope that you will give early clarification about all the points raised, will not force me to take any legal action.
