I am a mobile retailer in the trade name of Sri Infotech at Raniganj, Dist: Burdwan, West Bengal. I have been selling Nokia Mobiles from the last 2 years. I had purchased a Nokia X3-00B silver with IMEI No. [protected] from M/s Avantika Garments Pvt. Ltd., 40/74 G T Road, Asansol on 21/08/2010 wide invoice no. AGPL/ 9941.

When I opened the box to sell it to a customer, the mobile handset was not found in the box. The box had only the battery, charger, headphone and date cable.
When I contacted the Sales representative of Nokia ( Avantika Garments Pvt Ltd. ) Mr. Rupesh Pan, I am being told that why didn’t I weigh the box before taking delivery and that the delivery boy was not attending office from the last three days.
Then I was told that this case has also occurred earlier in Raniganj with M/s Shri Shyam Agencies and Jagabandhu Telecom some four months ago. Mr. Rupesh Pan and a sales promoter of Nokia were also present in the outlet of Shri Shyam Agencies when a sealed box of Nokia 7210 had the handset missing from it.
After my constant nagging from the morning I am told to do a 50-50 settlement. Is this right? Why do I made to pay for a handset which I did not receive. Is Nokia dealing in mobiles or grocery items that weight need to be done before taking delivery?
If such cases happen who will sell Nokia? Is Nokia here to loot retailers? Will Nokia fill its booty by selling sealed boxes with handsets missing from them? Is this a new trade policy which Nokia has build up?
A complete crackdown on the case is required, so that fellow retailers are not cheated and justice is met to me.
