[Resolved]  Parswnath Developers Ltd. — No communication for the work held up in their Parsvnath, Planet, Lucknow scheme

I had booked one Flat in Parswnath, Planet Scheme, Lucknow. It in Tower-6, Flat No.4. Company promised to give the possession of the flat by August-09. The work on the construction site at Vibhuti Khand, Gomtinagar, is stop from the last nine months. Three towers has not reached its specified floors. Even brick work is incomplete, leave aside the extrnal plaster, panelling, sewage, undergorund parking. Their regional office at the site is unable to answer why the construction activity is being stop. They are saying it will now start in June-09 and project is late by about a year. But I have my reservations that it will be completed within one year, even if the construction work start in June-09.

When I sent mail to them about a year ago, one Mr. Himanshu Dingliwal from marketing wrote me that possession will be on time. After that I have sent them many mails to them & even one to Mr. Rradeep Jain (CMD). All the mails were recieved by the company but not replied. I do understand that realty sector is under pressure, but such type of irresponsible behaviour by the company with the person who have paid about 80% of the cost of flat to the company is really horrible. I am pitty for those who have made 100% down payment to the company and there is still no sign of the completetion of the project. Iam copying the mails I have sent to the company.

May be they listen to you.

In the end November, Mr. Dingliwal informed me that I will get the possession in the third quarter of 2009. I wrote that mail after visiting the site. After visiting the construction side, I had my reservations of timely completion of the project because very slow construction activity was going on. Even columns & structure of few towers was not completed, leave aside brick work etc. He replied casually to my mail without taking into account the ground reality at Planet.

Anyways, I again visited the site yesterday, but with a different purpose, i.e. 26.03.09 and was socked to see that there is no construction activity at site and came to know from my sources that it has bees stopped since January. I met Mr. Johri and show him the mail sent by Mr. Dinglival. He refused to comment on his commitment. He tried to convince me that work will start in the month April and will be finished within one year. I do not believe him and want assurance from the Top management about the date of completion of the project. This is my right.

Further Planet was sold to me and others are Modern residential complex. But from the last four weeks Rishita Properties, is offering Commercial spaces on ground floors in local news papers. In your offering brochure, the company has not informed, in any way that Planet is commercial cum residential complex. How come there could be about ten or more commercial establishment of any kind and nature in the housing complex. I now believe that company like Parsvnath misinformed its Planet buyers at the time of its booking. I booked the Flat just on the basis of Brand Parsvnath, but now I am shocked. This is not acceptable and company Like yours should not indulge in such practices. It will be great chaos at planet as many outsiders will be entering the complex on the pretext of visiting the commercial establishments and will be potential threat to the security of the inhabitants.

I request you to review your decision and let be Planet a simply housing complex, as the company has promised me. This is not done.

Please see that my this mail is not ignored at any level and be replied at the earliest.

I visited the site one week before. There was no civil activities going on on the site. Further I have paid my dues upto start of internal plaster. But internal plaster in T-6 tower has not started even on ground & first Floor.

Please clarify.

Hello sir, I have also booked flat under planet. The project's construction is standing still for more than 7 months now. Currently the marketting staff tells new new reasons for delay and tell us a future date, but no luck so far. I and one of my frend are clueless as what to do.
I have also booked a Apt in 2007 in same project, but since I am outside Lucknow, was not able to followup. can we form a group and then go to consumer court/contact their management/go to other print media because now it seems the work has not moved at all.
I am in the similar boat, worst thing is that this is from Parvnath builders who were supposedly better than others. At least a simple form of communication about the delay and potential completion date must happen.

What about the penalty clause for delaying the handover/possession and how is that going to be paid?
We need to form a cummunity and proceed legally to Parsvnath. Since it is very clear that most of the allotees have paid almost 80-85% of the cost, there should not be any valid reason from M/s Parsvnath for delay in construction.
So pl do form a group jointly..we will put a legal case against the builder for refund of our hard earned money with suitable interest.

But be sure no body bothers what u write...they dont listen...as they are busy playing with your hard earned money..

First thing to do is to collect the data for interested allotees who want to persue a legal action.

Mr Jain MD of Parsvnath based at Delhi-Shahdra office repeatedly promised us to give us the possession at the earliest in Sterling apartment Arthla Mohan Nagar, but when still not known to us.AlmosT 85% money gone 7 year back with meagre penalty clause of just 5 Rs per square feet that too is not being followed as per agreement. Perhaps some responsible authority may wake up sometime to address our grievance's against erring big big builders. God should help us in our lifetime.
