REMINDER 1 9.7.2010
I REGRET TO INFORM YOU THAT I HAVE NOT RECEIVED REPLY TO MY COMPLAINT DT. 5.6.2010 AND THE SAME IS REPRODUCED AS BELOW:
The Provident Fund Commissioner, 5TH JUNE, 2010
Bavishya Nidhi Bhavan,
Plot No.222, Sector 3, Charkop,
Kandivli (West), Mumbai-400067
SUB: 1) NON-RECEIPT OF PENSION
2) SETTLEMENT OF BALANCE PF CLAIM
REF: MY PF NO. MH/8670/252, EMPLOYERS CODE NO. MH/8670 RELIANCE HEAT TRANSFER PVT. LTD.
Dear Sir,
I wish to bring to your notice that my Form Nos 19 & 10D were returned back by your office vide letter no. MH/8670/252/PF/ACCTS/39/1131 dt. 12.2.2010 with comments as given below and the same was received by me around 20.3.2010.
The claim has already been settled in 1997-98 & a provident fund amount has been released. Further you are not eligible for pension benefits as per EPS 1995.
I wish to bring the following facts for your kind consideration:
1) My Form Nos 19 & 10D,duly attested by Asst. Official Liquidator, High Court Bombay, were hand delivered through my friend on16.5.2008 at your office. Kindly note that Reliance Heat Transfer Pvt. Ltd. Went into liquidation as per High Court Order dt. 9.11.1998.
2) The reminder was sent by me to your Office on 2.7.2009 by Regd. A/D & Courier and your office took appox. 21 months to send reply without looking into the case correctly.
A) PENSION BENEFITS
1) Please note that I joined Reliance Heat Transfer Pvt. Ltd. On 11.8.1976 and I was member of Family Pension Scheme 1971 and deduction towards FPS 1971 was regularly done from my Salary from Aug. 1976 till Feb.1997.
2) Please note that I am eligible for Pension under EPS 1995 as per your website which is being reproduced as below:
Employees' Pension Scheme-95 came into effect from 16.11.95. The Employees' Pension Scheme-95 has been conceived as a Benefit defined Social Insurance Scheme formulated following actuarial principles for ensuring long term financial sustenance. The new Employees Pension Scheme-95, repealed and replaced the erstwhile Family Pension Scheme, 1971. The assets and liabilities of the erstwhile Pension Fund were transferred and merged with the new Pension Fund. The benefits and entitlements to the members under the old scheme remain protected and continued under the new Employees Pension Scheme-95.

It appears that Reliance Heat Transfer Pvt. Ltd. may not have transferred my registeration from FPS 1971 to EPS 1995
3) You will appreciate that if Reliance Heat Transfer Pvt. Ltd. has not deposited my PF deducted from Salary after March 1995, then how can we expect them to transfer my FPS 1971 to EPS 1995.
In view of above facts kindly advise me the action desired from my side so as to receive Pension on top most priority.
B) PF CLAIM
1) The claim towards PF was settled vide your letter no. MH/39/P/3305 dt. 31.3.1998 for Rs.4,23,733/-.
2) As per my calculations this PF claim was for deductions upto Feb. 1995 though I received Salary upto Feb. 1997, which may mean that Reliance Heat Transfer Pvt. Ltd. did not deposit PF deducted from March 1995 to Feb.1997.
3) Further as per my calculations the interest has been calculated upto 31.1.98 instead of 31.3.1998.
In view of above facts kindly advise me the action desired so as to recover the balance dues and also kindly furnish the calculations for settled PF Claim.
Thanking you,
Yours Sincerely,
A.C.SURI
