Sir,
I visited our flat 23a sheikh sarai, phase i new delhi. At about 11.30 on 13 august 2-16 i foind that mr jain occupant of the first floor over my flat in the same block had:
(A) broken the boundary wall of my flat. He had also broken the about 4 ft high steel bar fencing on the boundary wall. And thus had illegally trespassed in my locked flat without anybody's permission
(B) in the gap created by breaking the boundary wall till the foundation, he put up a steel girder about 9 ft high.
(C) by breaking the wall towards the drawing room side of my flat he made big hole in the wall and there he inserted a horizontal steel girder one end of which rested on the girder implanted in my boundary wall
(D) thus he created a frame work was making arrangements for covering the "open to sky" space of our flat by stone slabs small girders and other steel rods etc,
(E) when i told him that his totally illegal and unauthorused construction and yhat encroachment over the properties of others was not only iillegal but also immoral, he grew violent and stated shouting that the "open to sky space even if within the boundary wall of a flat belonged equally to others also and not only to the occupant of the ground floor.
(F) when i further told him that making big holes in the walls of the dda flats for supporting heavy steel girders and the layinig superstructure for about 200 to about 250 sq ft may put the entire structure of the considering that the flats were about 40 tears old, he curtly told me to what i liked. He furher told me that his own syster was an archirct who lived close by and she had apprived the illegal construction.
I immediatelty rang up 100 and told them of the damage being inflicted to my flat by breaking the boundary wall, making a ;deep and wide slit in the roof slab and making wide holes in the load bearing walls mr jain was making my flat dangerous and unfit to live blocking air and light practically to my entire flat.
After ringing up 100 four tmes and contacting the ps malviya nagar one sl/asi mahesh kumar of ps malviya nagar came at about 4 p. M and took photographs of the iliegal construction
When i wanted to give a written complaint to si mahesh kumatr, he asked me to go tp the ps malviya nagar who alone are competent to receive such complaints.
Accordingly went to the ps malviya nagar and hsanded over my complaint to the duty officer who informed that the beat constable shall go there and submit his report.
Wheb till four days nothing happened t+i rang up si magesh kumar and asked him as to how can i get a cop[y of his report. He said that that the invesygating officer shall contact me.
I would request you to kindly take immediate action torestore status quo ante and to make yhe flat safe and restore the natural light and natural ventilation of the flat. Ay the moment the flat has been rendered unsafe and unhealthy to live.. I may mention that i and my wife are senior citizens and suffer from several disabilities. We are afraid of even stepping into the flat rendered structurally unsafe to live
I myself am 80 years old and have 70% percent sisability attributabe to military service.
Despite the police report the said mr jain is still continuing with his illegal and unathorised dangerous to structure construction work
