In december, 2011, i purchased a flat (4bhk) in the emerald floors premier, phase-iii, sector – 65, gurgaon, haryana, but as on date, i have not got the possession of the flat. I have taken a loan against this flat and been paying heavy emi every month over the past several years. Now, it has now been seven years but builder emaar mgf is not ready to give possession.

Dear Saurabh, I am in a similar position.Emaar delayed my flat also, by 3 years, but did not. I asked for a refund due to the delay. They refuse to do that. I believe that Emaar is violating Govt rules and Supreme Court and National Consumer Disputes Commission rulings, which say that a developer cannot force a buyer to take possession for properties that have been unreasonably delayed. .
