We, mrs aarohi chavhan & my spouse mr anish chavhan booked a tuv300 with global gallerie agencies, mahindra, owla, gb road thane on 20/12/2015 via a cheque of rs. 20000/-. We were offered car loan from mahindra finance which we aggreed to. We were assured that the delivery of the car will be on 08/02/2016. But due to poor management of global gallerie agencies, delivery was delayed by two days & also formalities are still due. (No rc book, no proper insurance papers) also when applying for loan we were continously called every day for official paperwork which was submitted twice. Every day we use to get call for one one official documnet. No proper procedure was followed by mahindra finance dept (Mr akshay, ms sunita & mr. Samit) to collect the documents at once and clear off the loan.
The loan agreement number is 4233540 (Cope attached). It is on my name (Mrs aarohi anish chavhan). However we were not informed about the emi amount as well as the date of emi debit. We have been continuously following up with the mahindra finance dept of global gallerie, mrs sunita, about the same. She always promised to call back with the details but failed to do so. We have not received a single call from them till date. Also we did not receive any welcome letter from the finance dept. Of global gallerie till 28th of april 2016. Both, my husband & my mobile numbers are with the finance team of mahindra finance & global gallerie agencies which was also documented on the papers during the process. But we haven’t received any intimation from the team about the emi amount & date. Nor my bank, which is with icici, was informed.
On 28th april 2016, the mahindra finance team instead of informing my husband or me on our registered mobile numbers, they chose to send a message to our guarantor stating "refer mahindra finance a/c 4133540, hirer aarohi anish chavhan has overdues of rs.18050 as on 28.04.2016. You as a guarantor is requested to arrange for the clearing."
The guarantor informed us immediately about the message on the same day i.E. 28th april 2016. My husband, mr anish chavhan, immediately went to the mahindra finance office, no.3, 1st floor, sankalp heights, near flower valley, eastern express highway, thane. He met mr sushant sawant (Branch manager) and explained that we haven’t received any information about the emi amount and date. Mr.Sushant made an apology and accepted the mahindra finance dept. Fault. On confronting ms sunita and mr akshay of mahindra finance team of global gallarie agenecies over a conference call about the missed details to us, they accepted their fault and agreed that they missed to give us the details of emi. Mr. Sushant (Branch manager) handed us the welcome kit then which had details of the emi date and the amount with signing date of 28th april 2016 (Copy attached)
Now the mahindra finance is forcing us to make two emi payments of rs18050/-, one for month of april & second for may at once. Also, as per them, the emi of april will have delay charges for not paying on time which as per the issue was never informed to us until 28th april 2016. We have been mentally harrassed by the team & pressurised to pay both the emi's at once which is a total of rs.36100/-. We have requested the finance team to start the emi process from the month of may and we are ready to pay the emi for this month. But they have dreaded us that not paying the april emi with delay charges will impact our credit score history of savings account which may affect our future loan processes, in case any. They have been continuously calling us saying that we will deposit the cheque in the account to deduct the emi's. My husband has been given two different statements about the cancelled cheques we gave them during the process: (1.) mr akshay informed us that the cheque will be deposited & emi will be deducted, whereas (2.) again mr akshay informed us that since the emi did not start from month of march the cheques have been given to the mahindra finance office & they don’t have any. Now the company asking to give 6 more cancelled cheques or pay the entire emi amount in cash.
Also we have a recording where in mr akshay & the branch manager, mr sushant sawant are accepting that this is entirely their fault and there is no fault from our side. The entire process has been frustrating and torturing right from car delivery till date. My husband has been continuously harassed by the team for the payment which is taking a toll on his health and also affecting his business. He has to leave all his work & have meetings with the finance team explaining them the issue. But they are stubborn & continuously dreading us about the credit score history. Hereby expecting a support.
Again stating, we have permitted them to deduct the emi starting from this month. May 2016.
