Even after more than 2 years from raising demands for 95% of the consideration amount, the project has not yet been completed.
The project was due to be completed in February 2015 as per the Agreement to Sell. However it is not completed yet.
The Company had raised demand of 85% of the consideration amount by October 2013. Even after demanding for 85% of the total amount before 3 years from now company has failed to give possession as on date. All the earlier demands were unfairly raised with the fraudulent / malicious intention of extracting maximum money from the buyers without any sense of responsibility from the builder side.
In fact the company had demanded all except the last instalment of 5% by May, 2014. Such unreasonable and unfair demands were raised by the company against all ethics, codes and fair practices. Such acts have been severally reprimanded in several court cases and rulings. These are in violation of provisions of Gujarat Ownership of Flats Act, 1973. Such long delay in completion of project has been severely treated in recent court orders and FIR has been filed and even the builders have been taken into custody.
The company must unconditionally refund all the money to the buyers along with interest @18% PA i.e. the rate it charges on delay in payment by the buyers.
