Dear Sir,
This is regarding our booking the captioned flat No.801 in Godrej Upvan (Tower-9), one of the esteemed projects of Thane Extension. I would like to give my feedback, as under :
1. The agreement draft was not shared in advance, before going for Registration.
2. The Draft was not checked at GODREJ's legal/registration Team, rather prepared casually and let basic errors to remain there. The agreement placed for registration has following errors
A. Amount paid was incorrectly mentioned. The amount of Rs.3.51 lacs paid, which was mentioned as
i. Rs.1.85 lacs in words
ii. Rs.2.51 lacs in figure
iii. Even amount in figure & words mismatched.
Had draft agreement been provided to us in Advance, atleast we ourselves could have checked and alerted your team about the mistake in legal document.
B. This necessitated, filing of Rectification Deed with Registrar. Here again, the Rectification Deed was incorrectly drafted by your Legal Team, it fails in bringing about desired changes, on following grounds.
a. It only attempted to rectify the difference in word and figures as pointed out at A-iii above,
b. It continued with the underlying error of Rs.2, 51, 000/= (instead of Amount is Rs.3, 51, 000/=)
c. No sincere attempts for rectification. The expected changes about payment of Rs.3, 51, 000/= is not getting conveyed.
We mention here that our plea for correcting the mistakes in Rectification Deed went unheard by your team. In process we spoken with Ms.Isha, Mr.Manish, Mr.Robert, Mr.Rishi from GODREJ TEAM and also with Mr.Avinash Mali, the consultant.
In order to convince us, the GODREJ Team has put forth following (unreasonable) reasonings
- The advance payment includes GST, which needs to be excluded, while mentioning in Rectification Deed. (hence amount is Rs.2.51 lacs and not Rs.3.51 lacs)
- The Rectification Deed is vetted by SubRegistrar.
We mention here that we volunteered ourselves and reached Registrar Office, with sole intention of Rectifying the errors committted in the Registered Agreemeent. The Rectification Deed lacks the capabilities of bringing about desired changes, on following grounds.
a. It only attempted to rectify the difference in word and figures as pointed out at Error-3 .
b. It continued with the percolated error of Rs.2, 51, 000/= (instead of Amount is Rs.3, 51, 000/=)
c. The expected changes about payment of Rs.3, 51, 000/= is not getting conveyed.
Neverthless Rectification Deed (as drafted by GODREJ TEAM) is filed, we again pointed out to CRM vide our eMail Dated 25.08.2021 that it lacks the capabilities of rectifying errors committed in original agreement.
The reply we received from CRM is not convincing and shows ignorance and reflects lack of concern about the genuine facts.
We are constrained to appeal at this forum to probe by independent team for
1. How an error of this type occurs.
2. Establishing whether Rectification Deed does not fail in establishing that buyer has paid Rs.2, 51, 000/=
3. Is your team really sensitive to the Customer's genuine need.
4. Is there need for another Rectification Deed, as advised by bank, for
bringing about conclusive rectification, beside nullyfying the previous Rectification Deed.
We look forward for your sincere intervention in the issue to obviate further complication in the matter.
