I am an architect and journalist based in New York, and my father who is a client has been a lawfully associated buyer of one of the units in the Godrej Nature Plus 16th Parkview project. However due to pandemic restrictions, and ailing health issues he is currently not in the position to finish his final installments for the unit and we have been repeatedly approaching the Godrej team regarding this. One of their employees misled us and informed us that the cancellation process was not possible, and because of lack of information, my father believed their team.
Later we managed to make certain payments but currently are no longer in the position to bear any more financial transactions for this. I emailed them last week regarding the same.
Now instead of pushing the deadlines for payments, after discussing with our lawyer as per RERA law Section 18 sub-section (a) and the company policies, as buyers, we are allowed to terminate/cancel the project and receive the rightful refund.
I'd like the consumer forum to help us navigate to the right set of authorities and protect us from being misled, and fraudulent behavior.
We'd need to know the protocols for the immediate cancellation of our unit and initiate the payment refund for the same. I have also warned them within the email to not delay because they've been doing so.
I have also requested them to provide any other possible ways wherein we'd restrain ourselves from making any further payments and be penalized to meaningless interest charges since we are not in the financial position to continue this association. Despite our repetitive emails they keep on charging us with irrelevant penalties and interests even though the project payments are not just delayed from our end, but the dates have been extended officially from their end as well.
If there's a pandemic for them, then it also affects us as well. I would really want to resolve this issue peacefully without creating hassle for myself and the organization rather than getting into legal processes. Was this information helpful? |
