Godrej Properties — mis selling of project / not refunding booking amount despite reminders

Subject: GRIEVANCE - GODREJ ALIVE - FLAT NO. C -1602

Dear Sirs,

1) We had evinced interest in the project ONLY on the basis of the repeated assurances / emphasis given by Mr. Ajinkya Shinde, Sr. Executive-Direct Sales & his superior, Mr. Raghu Iyer at your Thane site office that Godrej Properties would be SOLELY involved in it from inception to completion i.e. right from paper work to construction to delivery of the flat and that we had to deal ONLY with you’ll (Godrej Properties Ltd and its employees) & NOT with any other entity / their employees. We wanted this assurance as we had a very TORTUROUS experience in the past with your JV partner & shared it (experience) with the above gentlemen.

2) As per the information / documents given to us, the required payment was to be made in favour of “GODREJ ALIVE A MASTER COLLECTION ESCROW A/C” & we had, accordingly, done this – payment was made through credit card on 20/05/2018 and 16/06/2018 for Rs. 50000 and 50000 respectively & vide cheque no. 000020 dated 20/05/2018 drawn on HDFC Bank, Mumbai-38 for Rs. 50000 i.e. a total of Rs. 150000 was paid to you as on 16/06/2018. We were allotted flat no. C-1602.

3) On checking our bank / credit card statements on 17-18/06/2018, we were SHOCKED & HORRIFIED to notice that the payment made by (a) the above referred cheque was credited to MTIL SPORTS CITY ESCROW A-C [ AN ENTITY NOT CONNECTED WITH THIS PROJECT](b) credit card was credited to the a/c of MODELLA TEXTILE INDUSTRIES LTD.

4) HOW IS IT THAT A CHEQUE ISSUED IN YOUR FAVOUR LANDS UP IN THE ACCOUNT OF A THIRD PARTY ??? THIS IS A FRAUD!!

At no stage were we informed, neither orally nor in writing, that the payments to be made by us would be credited to an account other than that of “GODREJ ALIVE A MASTER COLLECTION ESCROW A/C”.

5) We had visited your site office on 18/06/2018 morning & evening, discussed the matter with Mr. Ajinkya Shinde & Mr. Raghu Iyer, showed our bank / credit card statements indicating the above referred transactions [they had taken photos of the same]and informed them that under the circumstances we wished to OPT FOR A REFUND.

6) Mr. Ajinkya Shinde handed over a cancellation form to us & we had duly completed / signed it.

7) Kindly transfer the refund proceeds to our bank a/c at the earliest – details indicated in the cancellation form hand delivered & emailed to Mr. Ajinkya Shinde. The cancellation form is also attached herewith for your reference.

Updated by roshan1107 1) Sent email to Sr. Executive-Direct Sales, Ajinkya Shinde but there was no response regarding refund.

2) Tried contacting Site Head Raghu Iyer. He did NOT answer call nor respond to text message.

3) Escalated matter to Corporate Office. Mr. Sainath Nair, Customer Centricity was responsive. On 10/7/18 I was informed about a meeting at site office on 17/7/18 at 3 PM with Mr. Anand Ramachandran, Sr. Gen. Manager. I visited site office on / at the designated date / time. Mr. Anand Ramachandran did NOT turn up.

4) 1 MONTH HAS PASSED. DESPITE REPEATED REMINDERS / FOLLOW UP, THERE IS NO COMMUNICATION FROM GODREJ PROPERTIES AS TO WHEN THE BOOKING AMOUNT WOULD BE REFUNDED.
