I, Simple Magoon, r/o house no. 344, gali no. D- 26, Chattarpur, New Delhi- 110074, presently in Cameroon ( West Africa) with my husband and family, had made a booking of an apartment along with my husband Mr Kapil Magoon in the project of Godrej properties, Godrej 101, sector 79, Gurugram, Haryana, the unit details are as unit no. c 0703 on the 7th floor in tower c, Godrej 101, on the 11th may 2020.
Rera registration no 61 of 2017 dated[protected].
To mention that we had known Godrej as a very reputed company and have heard about the various successful projects of Godrej properties in Delhi, ncr, we knew that the Godrej properties is a very reliable and trustworthy company, so on the basis of these credentials of Godrej properties, the above-mentioned booking was done on video calls and video presentations by your marketing team, headed by Mr Paroj Dutta. Since we were in Cameroon, we did not even physically visit the project site and went ahead with the booking because of such tremendous confidence on Godrej properties.
The above-mentioned unit was duly allotted to us by wonder Buildcon private limited, on the payment of 10% of the basic sale price amounting to Rs 1399800 (rupees thirteen lacs ninety-nine thousand eight hundred)
The balance was to be paid on possession which was tentatively to be in the year 2021 and the same was planned to be from our own financial sources, as being NRI we don't have the facility of getting loans from Indian banks.
The booking of the said unit was done by me on the basis of normal circumstances and had never ever imagined that a pandemic like coronavirus would hit the entire world.
My business was very badly affected due to the onslaught of coronavirus/ lockdowns all over the world as we are into the business of importations of general goods from China to Cameroon by sea route.
The transportation through sea was totally suspended as China went under lockdowns, there was no supply of goods and the same continued over a long span of time, my entire supply chain affected, everything was turned upside down and all my financial planning was badly affected due to the same.
My business in Cameroon got affected tremendously, as a big part of my expenses were fixed, being a foreigner, all the premises, shop/ warehouses/ residential units were on rental basis.
All flights from Cameroon to India were suspended, so there was no way for us to come to India so as to look for some other financing options.
Further, we have been in Cameroon for the past 24 years and all our sources of income are in Cameroon, the business as mentioned above, without any source of income in India.
The same was explained to our Godrej relationship manager and she advised us to apply for a banking loan. We had mentioned to her that being NRI, we are not eligible for a banking loan in India. She further advised that we can at least try, so she referred us to one of the agents who was working with banks on behalf of customers of Godrej properties in the processing of loans. The documents as required were submitted and the process went on for several months, but finally, we were not able to get the loan approved (sorry to mention but we even gave some commissions to the agent to get the loan approved and on a fast track) so we had clear intentions of paying for the booking, but our luck was not in our favor.
So after looking out at various financial avenues, nothing worked out for me so as to be in a position to pay the balance amount outstanding.
As i was issued possession intimation letter by your office on[protected] and a demand of Rs 12605273 was raised.
Since that time, I have been requesting your office to cancel my booking and refund the amount of Rs 1399800 paid as booking amount by me. But till date, nothing has worked out and i have been getting the response that the same cannot be refunded.
Just to explain to you that i have a family of 3 kids (19 year old son, who has to go to university, 2 daughters aged 17 years and 14 years). All the responsibility of their education and upbringing has to be fulfilled by me. Furthermore, I have a dependent mother (76 years), my father expired at a time when i was still struggling, and this amount of Rs 1399800 is my hard earned money.
We would like to request Godrej properties to give a due consideration to our request of cancellation of our booking and refund the application amount paid by us.
We expect Godrej properties to respect our confidence and trust shown in Godrej properties, to the extent that we booked the apartment based on the words and video presentation of your marketing team.
We have a strong mindset that Godrej properties is a very reputed company, growing with time. So by the grace of God, we can still work with Godrej properties in the future.
