Re. Arbitrary demand of Rs. 2678662/- vide letter dated 20.10.16 as additional lease deed penalty without giving any detailed calculation. Plot allotted on 10.5.2000 measuring 12496.87 sq. mtrs. Actual plot identified and lease plan given on 6.10.03 with interest. A writ petition no. 28758 of 2005 filed with hon'ble Allahabad High Court decided on 16.11.2009.Execution of lease deed in accordance with court order asked vide letters dated 22.09.2010, 06.12.10, 15.3.11, 28.3.11, 26.9.11, 30.11.11, 9.3.12, 28.5.12, 31.5.12, 3.7.12, 17.8.12 but none responded and Court order not executed. First time on 23.01.14, a demand of Rs. 80, 48, 409/- as balance land premium and late fee, Rs. 17, 62, 278/-as Lease Deed Penalty, Rs. 704911/- as Functional Penalty without providing any kind of details thereof. However the same were promptly deposited despite of the fact that without execution of lease deed as prayed in several letters and physical possession of plot, how lease deed penalty and non functional penalty could be imposed. Allottee has been consistantly chasing Authority for execution of lease deed from the day of hon'ble High Court Order but Authority failed.A further demand of Rs. 176500/- raised for Lease rent which was promptly deposited. Still no no dues certificate issued nor action taken for execution of lease deed despite our further letters dated 15.09.14, 22.09.14, 23.09.14, 15.10.14, 19.01.15, 21.01.15. We were advised to purchase stamp papers worth Rs. 650000/- for lease deed which were purchased on 04.01.2016, even after that deed was not executed. The Authority confirmed to the State Secretary Mr. Parth Sarthi Sen Sharma having received full payments. Now all of sudden another demand of Rs. 26, 78, 662/- has been raised as some additional lease deed penalty without any detail. We are intentionally being harrased by the authority employees for the last 16 years despite our constant follow up and prompt compliance for some obvious reasons.
