My Dad had bought a flat in Bhayander (E) in 1994 for Rs.2,25,000. He had given the amount of 1,50,000 through Bank loan and the rest of 75,00 was to be given through cash. My father had given this amount and he has two reciepts of Rs 2,00,000 and Rs. 25,000 as token, which makes the total sum of Rs.2,25,000. However, the builder had not given possession of our flat since 1994 as he said that the 75,000 were not paid. Whenever my dad used to visit him he used to tell that he wants the original documents of the flat then only he will talk on this issue. On Jan'12, my father recieved the property documents from Bank after full payment of the loan and we approached the builder.
But now he says that we have to pay up Rs. 13,50,000 which is actually the cumulative interest of 18% on Rs. 75,000 since 1994. Only then he will give the possession. Or he says he will give us Rs. 1,50, 000 which bank paid him and we should surrender the property to him.
We have all the original documentation of the property with us. But due to financial condition, we cannot file a case against him. Please advise how we can proceed in this case.
i am a flat owner of the same project, i find the project good and has the best facility, were as i don't consider the above right, the company is going good i am happy with my flat, there is good flooring, at least i have seen many other owners with the same feel, they find it good here, like a good posh society, its best for any body to have a flat at such a prime location, i have paid my booking amount and is paying regularly my loan amount, they are nice people, i think lucky you are bit mistaken, its not a laldora, and one more thing noida has no laldora land, i have checked it with the noida authority and others, it a freehold plot. lucky must have done something wrong, because one of my installment was also pending for the booking amount, but i later paid and there was no such pressure, i have done all the legal documentation before hand and i am going good with it .
i think lucky you must be a fraud dealer, bamaatech is not entertaining any 3 party dealer for his customer, so i thing you must be angry for this. .. please cool down, if YOU ARE A FLAT OWNER PLEASE SEND US A FLAT OWNERS COPY, send me the related document if any, i suppose you dont have them . i am into legall i will see into it . i have also attached my flat image for the same, and i dont find you in the registerd society people .
