Subject: failed delivery of the datsun go plus but successful loan and emis taken


Respected sir/madam,

I have had to bring this to your notice as it’s the height o[censored]nprofessional manner in which your dealership has conducted business with us.

My name is mrs. nazma shaikh who unfortunately got stuck with hdfc as the loan provider for a datsun go plus red back in february of 2015 through your dealership. the hierarchy of the events that lead to this ill fate are:

7th feb 2015 – we booked the datsun go plus by paying rs. 11000 as down payment
24th march 2015 – we receive a letter from you about the delay in delivery of our car

Your letter assures us that you will try to deliver our car soon.

We put our trust in you and continue paying emi to hdfc. so technically you have taken the money from the bank and we are paying for that for nothing. despite of repeated contacts you chose to keep things to yourself whilst we were loaded with paying emi for the money you took from the bank.

As per your attached letter you as a dealer failed to deliver the car. afer many months, we were told that you are going bankrupt and had to shut down your business in malad. the consequence of which was that we won’t get our car; moreover, your company has also failed to successfully notify the bank about your inability to deliver the car to us. this has put the bank under the impression that we have stopped payment out of our will.

This has serious implications on us. we are being harassed by collection calls and letters.in addition to this, we have been charged more than rs. 80000 as emi by hdfc for a car we don't possess.

We have been trying to contact you to get this resolved since a year however we seem to be stuck at square one. you head – customer relations ms. madhubala wadkar is not an inhabitant if the planet earth. i have called her a zillion times and all she has to say is ‘she’s unwell’ or ‘not at work’ or granddaughter hospitalized. can you imagine this is all she’s got to say when we call her?

I have called her multiple times; but always been told that she hasn’t got a chance to check my file. so i have had to resort to send this letter to you so that probably when you check your emails you'll see our account information and provide us with an update.

To make things easier for you i have my attached documents along with this letter.

We have been patient with kamal nissan and hdfc for over a year now and to be honest this is getting very silly and stupid that it's taking so long for this to be resolved.

Ms. wadkar told me that hdfc is slowly paying back affected customers but then it's not hdfc whose at err. you’re the one who has all the money. we paid you and so did hdfc pay our sanctioned loan amount to you.

It’s the responsibility of your organization to coordinate with hdfc to identify these accounts where the error was on your end to stop collection calls and letters. we are in this situation because of you. it's the failure of your organization that you were unable to fulfill your commitment of delivering the car to us.

I am on the verge of seeking legal guidance because i'm afraid that we'll end up bearing the brunt of this by having negative impacts on credit report. we are unable to buy another car because of this mess.

So this is my last resort to contact you and get this resolved. i urge you to take some time out of your busy schedule to help us out of this situation and rectify the damages we have suffered. the loss we have incurred are:

Down payment of rs. 11000
6-8 emis of more than rs. 11000 paid to hdfc
Harassment calls from hdfc and collection agencies
Ongoing mental stress for more than a year to get this resolved

I would appreciate if you understand the gravity of this letter and respond immediately. we’d like a speedy resolution now as we have given you ample time. what we expect from you is to,

Return the down payment
Return the loan amount to hdfc
Return the emi we paid to hdfc (so you can pay us our lossed and return the rest of the loan amount to hdfc)
Get the collection calls stopped immediately
Compensate us for the mental and emotional stress we have suffered
Arrange for an equivalent car to be given to us

I give you a week to respond to this letter from the day you receive it. our contact details are:

We have given you ample time and been very patient, however got nothing in bargain. we just want you to be fair and human in addressing this concern as we aren’t asking you for your money but ours.

This incident has left a very bitter taste in our mouth and we have lost faith in dealers like you.
