I had taken possession of Flat No. 1203 in B wing of Rustomjee Seasons and had moved into the apartment after furnishing and renovations in May 2020. Since about September 2019, the geyser in the 3rd bathroom has been consistently malfunctioning.
It had stopped malfunctioning and on 4 earlier occasions and the technicians from Jaguar had visited and repaired the Thermostat and burnt wire.
On 8th July 2020, I had sent a detailed email to the Crest team, which maintains the property on behalf of the builder/ society, pointing out that within about a week of this geyser being repaired, it again stops functioning and hence, during the last year, the geyser was used for hardly 30 days.
After my last complaint in July 2020, Mr. Mohammad, a technician from Jaguar, had advised that the geyser be removed and accordingly it was removed and was taken by Jaguar team for repairs. This 5th complaint was given Complaint No. 00448942 by Jaguar.
About 10 days ago, 3 persons came to my flat no. B-1203 and reinstalled the repaired geyser. However today the geyser has again stopped functioning and I had to again take bath in cold water.
I do not see any reason why any attempts should be made to repair the geyser again, when it is not functioning even after 5 attempts to repair it. I do not want to suffer any more. This amounts to deficiency in service under the Consumer Protection Act.
Hence you are called upon to pay damages of Rs. 1, 00, 000/- for deficiency in service and causing physical and mental harassment to me and my family .
