I conclude that the delay was on the part of
1) Royal Nepal Airways and/or
2) issuing agent of the e-ticket
from the description above,
as Royal Nepal Airways delayed the arrival of passenger to the terminal (see
1. ICAO document STA/10-WP/7 dated 16/10/09: REVIEW OF THE CLASSIFICATION AND DEFINITIONS USED FOR CIVIL AVIATION ACTIVITIES, particularly term "International airport" in page 7 of 9 total
2. Art 19, 29 of CONVENTION FOR THE UNIFICATION OF CERTAIN RULES FOR INTERNATIONAL CARRIAGE BY AIR, 1999
Accordingly, the duty of nepalies (Royal Nepal Airways) was to provide passenger with
- accomodation
- meals and drinks
- first availbale flight
In addition, if you have eiticket worth 25000 rupees, you can claim this amount in addition from the nepalies and/or from the travel agent via the DGCA of civil aviation or via lawyer (for fee), using the legal procedure in any state, where Royal Nepal Airways operate their flghts.
Nevertheless, it is a preliminary conclusion, which is not valid without evidences such as
- e-ticket,
- response of representative of Royal Nepal Airways and/or
- responce from travel agent
Record of the conversaion with arport (ground) staff which were servicing Air China 438 flight at Kathmanu airport can be a plus for securing evidences.
