Mphasis Ltd — Not issuing form 16

Greetings!!

This is to bring to your notice that i served mphasis limited since october 13, 2014 to august 28, 2015. however, in spite of multiple followups i did not receive my form 16 for last financial year yet. i logged cases (ref: 957272 & 966532) with mphasis hr helpdesk; however, both the cases were closed stating that i have to wait for 10-12 working days.

Today i spoke to mphasis hr helpdesk who declined to issue my form 16 on the account pending dues.

However, firstly there is no due (no due certificate has been issued by mphasis) and secondly, according to section 203 of i-t act, employer needs to issue form 16 if tax was deducted from employees income.

Also, the employer should issue the form 16 by 31 may after the end of the relevant financial year in which the income was paid and tax deducted. and if the forms are not issued by then, under section 272a (2) (g) of the i-t act, the employer is liable to pay a penalty of rs.100 per day of default till it issues the form.

I request your kind intervention for release of my form 16 from mphasis at the earliest & help me file income tax asap which is the responsibility of every responsible citizen of india.
