We (Myself & My Sister) Booked commercial Shop in Omaxe Connaught Place, Greater Noida on 10 February 2021 through 360 Relators, Patna. Upon request from 360 Relators Agents second payment was made on 22 February 2021, receipts of which both are enclosed herewith. Customer ID OCPK/3132 against allotted Unit: OCPK/FIRST/460 in Omaxe Connaught Place, Greater Noida. On 20 March 2021, Incorrect Allotment Letter was received where in (Personnel Details and The Saleable area was wrongly mentioned). Same was duly notified to 360 Realtors Agents after scrutiny by self. Corrected Page’s soft copy of Allotment Letter was received on 03 April 2021. Verbal cancellation request of BBA / refund request was conveyed to 360 Relators on 3 April 2021 due to some financial constraints, substantial issues in the draft agreement as well, like with regard to certain dues, property measurements uncertain and too broad clauses. Several Cancellation and request for refund by email sent to relevant 360 Realtors and Omaxe on 4 April, 7 April and 9 April 2021 conveying me in ability to go ahead with the purchase and refund request. It was then promised to me that my advance payment of 3, 76, 000 will be adjusted in my sister’s unit balance payment. But to my despair, Undue Pressure was built on my Sister to make payment post COVID Lockdown for Full payment and my advance booking amount was not adjusted then making false promises that Oamxe will refund my Booking amount separately. All this while when we were in communication with Omaxe and 360 Realtors Agents, to my utter surprise Forfeiture email was sent by Omaxe on 09th September 2021. Note here that the forfeiture letter states: "despite of our demand for payment of balance due installments in more than two occasions followed by the letter giving you the last and final opportunity to pay the due and outstanding amount to avoid cancellation of allotment o[censored]nit, we have not received the due payments from last three months." Please note that no such written demand / letter has been made / sent to us. This seems obvious since the forfeiture letter does not mention any date as such. Further, regardless of its factual veracity, this statement is contradictory to their own stand since Omaxe was well aware of our cancellation request several months before this letter was issued, and they had themselves acknowledged our request and responded to look into it. I request your kind attention in this matter as both parties have stopped responding to my various calls and emails. Had I been at fault, I would have understood the forfeiture letter, but here I was always kept in dark by both Omaxe and 360 Relators that your booked money will be refunded. The Allotment letter also states to make payment within 30 days of physical receipt, however original letter doesn’t stand good because of its incorrect details e.g. Name & Area. Self had informed both parties in good time and observed due diligence at all times, and was promised of refund also, however above is the case now. All communication and receipts etc have been attached herewith for your kind perusal. I kindly request the Respected Forum to intervene and help.
