My rc book was seized by a regular policeman at a naka (rwale, airoli) for apparently jumping a signal. after showing him all the documents in original, he asked "how should we settle this"? on being told clearly that i intend to pay only rs.100, the official amount for jumping a red light, he seized my rc card then rode away with it to come back with a challan slip. the challan slip has no provision for seizing the rc but has been modified by hand to mention that my rc has been seized.
Question#1:when i am ready to pay the fine on the spot, is it legal for the police to seize my rc just to make it inconvenient to come back the next day to pay the same fine? if it's illegal i wish to initiate a legal complaint.
Question#2 : can a regular policeman check me for traffic offence and seize my original rc card? if he is not empowered by the law to do so, i would like to initiate legal proceeding against him.
