Respected Sir,
This is to bring to your kind notice that our family had booked six plots with Omaxe Garv Buildtech Private limited way back in 2010 & 2011, even after 13 yrs. of booking wherein full the payment for the 3 acre plots (375 sq yds) was made at the time of agreement in 2010, the rest three plots (240-265 sq yds) where the payment was made according to the given payment plan. Despite many reminders and emails, we are not getting any concrete answers & but till date none of the plots have been given the possession. These plots were to be allotted latest by 2012, as per the agreement.
It is incredibly frustrating for not getting the plots delivered by the builder even after 13 yrs. This amounts to cheating by not stating the true facts or making false promises as the Builder has failed to deliver the project within the stipulated time.
Till 2015 no possessions were done by the company. A legal notice was sent to the Builder on 21st Sept 2015 for the acre plots which was unanswered, later on a reminder was sent on 31st oct 2015 for the same which was replied on 26th Nov 2015 stating reasons that the state government had failed to provide land on the multiple reasons the company could not develop the land for Hi-Tech Township. Company is still trying to approach the state government for revival of the project & that the company has suffered huge losses.
They have also cancelled one of our plot in the name of Dr Anita Fotedar (now a Senior Citizen) No OMWL/L/P1/87 (copy enclosed) during the time of Covid-19 wherein more than 50% of the payment was already made. The demand letters for the same unit had been deliberately sent on the old address at SGPGIMS despite the new address being communicated to them.
This amounts to the harassment of a Senior Citizen during the Covid period. They requested me to write a letter to them requesting the revocation of the said cancelled plot which was submitted by me in the Omaxe office on 30th Nov 2021 where I also mentioned that I am ready to make the balance payment subject to proper demand notice. Also I gave my Aadhar copy for the updated address (copy enclosed). Despite paying Rs 2, 00, 000 during Covid period they have cancelled the plot citing reasons best known to them.
We gave an application to Public Grievances Cell at DGP office on 17th April 2023 & on 23rd May 2023 (copies Attached) for registering an FIR but the investigations were done in their favor stating that the company is registered with RERA in 2017/18 and they have given them the permission to give the possessions till 2025. The proper cancellation notice dated 5th May 2023 was received only on 10th May 23 offering a refund of Rs 10, 29, 695 against 11, 29, 000 deposited with them.
Moreover the area of the plots was also reduced from the initial allocated area and on site the plots are not yet marked it’s just an agriculture land without clear demarcations
Furthermore, now the builder refusing to return our emails/ calls and is still continuing to delay the delivery of our plots which has drained our energy, focus, and mental tranquility. We have not only lost money but also the interests incurred in past 13 yrs. along with disrupting our family's peace.
The Builder has also failed to provide a valid sales agreement despite an advance payment. Especially on the cancelled plot, they have been talking money but didn’t have any valid agreement in records.
Therefore I request you to register a complaint against Mr Mohit Goel CEO, Mr Rohtas Goel Chairman, Mr Radhey Goel, DGM, Mr Jatin Goel, & Mr Mukesh Kumar Incharge.
