Subject: Follow-Up on Refund Request - Breach of Contract
Dear Park Royal Holidays,
I acknowledge your response to my previous correspondence regarding my request for a refund, but I must express my extreme dissatisfaction with your reply. Your attempt to justify non-compliance with the terms of our agreement based on "non-cancellable and non-refundable" policies is both unfounded and unacceptable.
As per our membership agreement, I am explicitly entitled to a six-night, seven-day stay within the current financial year, which includes both breakfast and dinner. However, your company has repeatedly failed to honor these terms, offering only one night with breakfast alone on several occasions, and denying my entitlement to the full two-night stay. This is a clear breach of contract and is unacceptable under any circumstances.
Your failure to provide the agreed-upon services constitutes a material breach of contract, which gives me the legal right to terminate this agreement and demand a full refund of the membership fees. The terms you refer to in your response cannot supersede the actual contractual obligations you have failed to meet. Your refusal to fulfill these obligations puts you in direct violation of the agreement we entered into.
Let me remind you that:
1. The membership terms explicitly guarantee a six-night, seven-day stay with breakfast and dinner within the financial year, and this has not been honored.
2. Despite multiple attempts on my part to communicate the issue and request the services I am entitled to, your company has consistently failed to deliver, which amounts to a breach of contract.
3. A non-refundable policy does not hold up when the service provided does not match the contract or is insufficient. Your company's actions, which do not align with the membership benefits, have left me with no choice but to demand a refund.
If this matter is not resolved promptly, I will have no choice but to take legal action. I will file a formal complaint with consumer protection agencies, pursue claims through dispute resolution services, and seek legal recourse for breach of contract. I trust you will treat this matter with the seriousness it deserves.
I expect your full cooperation in processing my refund request within the next seven days, failing which I will proceed with all legal and contractual remedies available to me.
