Sub : request for registering complaint of fraud against m/s, premia structures ltd., having their corporate & registered office at a-5, 6, 7, sector-9, noida, uttar pradesh 201301, for cheating and committing fraud by unlawfully selling their commercial project “crown of noida – premia sector 62”.

Respected sir,

This is a complaint of cheating and harassment by the builder, mr. Tarun shienh who is cmd of m/s. Premia structures ltd., a-5, 6, 7, sector-9, noida-201301 (Mobile no. [protected]) and he has unlawfully sold his commercial project by the name crown of noida – premia sector 62. We the undersigned had made a booking of 150 square feet office space customer id psl-com-1737 project on 03 february 2015 and have made a total payment of रु. 593, 998.93 through net banking to the builder.

Photocopies of the receipts enclosed for your ready reference. As per the application/agreement (Mou), the builder also promises to pay us assured return every month @ 12% from 2nd installment onwards, which was never by the builder and no justification was provided for the same.
It is to be noted that even after passing of almost 3 years, construction of the aforesaid project at the site has not even commenced (Except occasional digging at one piece of land with 1 jcb machine for the last couple of months) and thereby compelling us to believe that this project is a sham and fraud committed by the builder.

We along with other aggrieved investors started approaching the builder from time to time through personal visits, emails and phone calls demanding our money back which was deposited by us with him but his offices repeatedly ignored our requests and kept on falsely assuring that the construction would start soon at the site and premia group is committed to deliver the same within time frame, which is now a very big ‘?’ mark.
His dishonest and fraudulent intention is felt and is proved beyond doubt from the fact that the builder fraudulently induced we buyers to invest in his aforesaid project about 3 years back concealing the fact from us that had had no approvals from the greater noida authority (Gnida) and other authorities for this project thereby cheating and defrauding us to grab our hard earned money. It was revealed only after some time when some o[censored]s filed rti with the gnida that even the land for the said project at “crown of noida – premia sector 62” did not belong to premia structures pvt ltd. While as per rule “no developer can sell any unit in a project without getting a building approval from the authority”. I have already written couple of emails and letters also to the builder to refund our money but no response received so far to this effect (Photocopies enclosed).
Yet another shock came to us when we saw a press release in daink jagran and other leading newspapers of 28th april 2016 headed “premia group ke kheelaf darj hoga fir case” where premia group has clearly been declared fraud and cheater for cheating their investors in their sector 62 noida project by the name 'crown of noida'. The ceo of noida authority has clearly stated that premia group has sold this project without even the land allotted by the authority.

Copies of these press releases would have been shared by other applicants already & hence i am not attaching the same.

In view of the above kindly register our complaint also against this company. We sincerely hope that the matter will be appropriately investigated and our hard earned money will be recovered from this company at the earliest with an interest @ 18% from april 2015, the date he was to have commenced payment of assured return.

I have written in this respect to police station noida in may 2017 but they did not even give me a receiving and also diud not register the fir.

The matter was also taken up with pmo office, but they referred the matter to up government.

Up government has not yet reverted back. An rti in the matter was sent to up government in september 2017 and revert is still awaited.
