Subject:- Regarding unfairness action on Motor Insurance claim
Dear Sir,

I had purchased Car model Ford EcoSport 1.5(D) Trend (O) Model-2014 by availing loan from State Bank of India, Loktak Branch. As per request made by SBI Loktak, I had renewed vehicle insurance from SBI General Insurance. My Insurance Policy number is No.[protected] covering the period from 28/01/2017 (00:00 Hrs) to 27/01/2018 (Midnight). Unfortunately, I met with an accident on 28th February’2017. I informed the said incident immediately to SBI General Insurance authorities. As per the direction of SBI General Insurance Authority, I took my vehicle to M/S Ford Imphal an authorised dealer/repairing centre of EcoSport. The vehicle was also got inspected by own mechanic of SBI General Insurance as well as by EcoSport authorised mechanic. Accordingly, the claim was registered with SBI General Insurance under claim No.356068 on 2nd March 2017.

2. After getting repair of my vehicle and completion of inspection by SBI GI Mechanic, I made the payment with good faith to MI Ford, Imphal. After adhering all formalities, I had submitted the original bill to the In-charge, SBI General Insurance, Imphal. But, I have not received the claim amount even after lapse of more than two months. It is unfortunate that the SBI General Insurance authorities vide their Registered letter No.RM[protected]N dated 12/5/2017 and Speed post No.EW[protected]IN dated 04/08/2017 have informed about forfeiture of my policy duly informing that my erstwhile insurer has denied my eligibility of 25% No Claim Bonus while renewal of my policy with SBI General Insurance. Hence, directed me to deposit a sum of Rs.3587/- towards the cost of No Claim Bonus allowed at the time of renewal of policy. In response to the said requirement, I had immediately remitted a sum of Rs.3587/- vide payment No.59811862 Jnl through SBI GI agent on 15/06/2017. Even after remittance of NCB amount, I did not receive the claim amount so far.

3. In this connection, I approached the agent to enquire the matter. In turn, he has informed me that my insurance policy has been blocked due to unknown reasons. Hence, I requested the SBI General Insurance Company to re-consider my claim keeping in view the following points:-

 If there was any short coming in my insurance application, it should have been rectified before accepting my application, but my application was accepted and the company issued me insurance policy No.[protected].

 I have registered my claim in 2nd March’2017 and submitted all required documents to the incharge SBI GI Company. The vehicle was repaired and delivered to me after proper inspection by SBI General Insurance Mechanic. How can the SBI General Insurance Company forfeit my insurance policy after submission of my claim without prior intimation to me. The SBI General Insurance Company vide letter dated 12/5/2017 which was received by post office Churachandpur on 10/6/2017 delivered to me on 12/6/2017 mentioned that I was sent a letter dated 10/3/2017 to deposit recovery of No claim bonus amounting to Rs.3587/- but the said letter was never delivered to me till date. Whether the letter was actually sent to me or otherwise can be verified from the postal register number by the insurance company.

 I was asked to deposit Rs.3587/- to received my claim by the incharge SBI General Insurance, Imphal. Accordingly, I deposited Rs.3587/- through agent vide deposit No.59811862 Jnl dated 15/06/17 but till then I have not received my claim.

 Photographs of my vehicle after accident and after repairing were taken by SBI General Insurance Mechanic at EcoSport authorised dealer MI Ford repairing Centre, Imphal. Not satisfying with the photographs taken by SBI General Insurance Mechanic, the SBI General Insurance agent was sent to my home to take photographs with vehicle so that the claim amount could be released as per direction of Mr. Arindon Choudhry of SBI General Insurance Company. The SBI General Insurance agent came to my home and took photograph with the vehicle and submitted to the SBI General Insurance Company, Imphal but the claimed amount not received by me till date.

4. Even after submission my genuine grievances, the claim amount in question has not been received so far. This kind of mischievous act shown by such a reputed company towards his customers who have believed fully and contracted for vehicle insurance has put me in huge surprise and embarrassing position.

In this regard, I once again hereby bring following facts into your kind notice to take due decision and issue suitable direction to concerned for early payment of entitled insurance claim amount:-

 It is again reiterated that as stated by SBI General Insurance Company vide their Registered letter No.RM[protected]N dated 12/5/2017 and Speed post No.EW[protected]IN dated 4/8/2017 and their letter dated 10/3/2017 through which I was conveyed that my erstwhile insurer has denied my eligibility of 25% at renewal of my policy with SBI General Insurance has not been received by me till date. It is blind to me that whether the letter dated 10/3/2017 was actually been sent to me or otherwise. Because, whatever letter they have sent to me SO FAR were received correctly except the letter in question dated 10/3/2017. If the SBI General Insurance Company has sent it by Registered post, the registered letter number and date of its despatch needs to be furnished by the firm, but they have failed to furnish the same till date. This leads to me to imagine about suspicious / some foul play on the part of SBI General Insurance, to avoid payment of claim amount to the customer.

 As per page No.12 of vehicle policy provided to me, on 31/01/17 the SBI General Insurance has asked M/S Bajaj Allianz General Insurance Co., Ltd, Pune i.e. my erstwhile insurer to confirm within 30 days time limit whether my declaration about my entitlement for 25% on my previous policy with them and has not filed any claim in the expired policy is correct or otherwise. In case of non receipt of confirmation within the time frame, it shall be deemed that the information provided by me is true and correct. It is necessary to provide copy of erstwhile insurer vide which it was denied, but SBI General Insurance has failed to provide me the copy of same till date.

 As per conditions for claim settlement, the company will settle the claim under this policy within 30 days from the date of receipt of necessary documents required for assessing the claim. In the event that the company decides to reject a claim made under the policy, the company shall do so within a period of thirty days of the Survey report or the additional survey report as the case may be in accordance with the provision of Protection of Policyholders interest Regulations 2002. Thereby, I predict that the SBI General Insurance has failed to comply with the above provisions. In order to cover their mistake/inordinate delay in settlement of claim, the SBI General Insurance Company has bluffing that they have sent me a letter dated 10/3/2017 through which I was conveyed that my erstwhile insurer has denied my eligibility of 25% at renewal of my policy with SBI General Insurance and on the above plea they are not settling my claim.

 It is also not understood that whether the erstwhile insurer has denied my eligibility of 25% at renewal of my policy with SBI General Insurance, then what is the purpose for collecting a sum of Rs.3587/- from me on account of the No claim Bonus recovery. Thus, the denial / non settlement of claim amount to me seems to be irregular/unjustifiable.

 From the above, it may kindly be seen that the SBI General Insurance Company has wilfully held up the settlement of genuine claim amount to me without sufficient reasons in order to cover their own mistakes.

 Besides above, it is also learnt that SBI General Insurance is giving torture to the agent in this regard.

In view of the foregoing facts, I humbly request you/RBI to interfere in this matter and find out the factual position and direct concerned SBI General Insurance authorities to settle the claim amount immediately.
