Spice Mobiles — battery swelling

I brought mobile handset spice mi-535 from homeshop18 and after 2 month mobile battery got swelled. And service centre person refuses to change. And saying that there is no warranty or guaranty for mobile battery. Than sir what is my fault it may be manufacturing fault of battery or any other issue and i am not going to do any compromises there is only one possibility that is exchange of battery.
