Sir/Madam,
I am the account holder of the aforementioned account number in your bank and through this letter would like to bring the following to your notice;
1. That after several unsuccessful attempts to either reach the developer and bank to secure the possession of the flat, the complainant approached RERA and after successful pursuit of the matter a recovery certificate has been issued by the authority in favour of the complainant and against the developer. (Annexure 1 to be provided via email)
2. That complainant approached Honorable High Court Allahabad seeking issuance of Writ of Mandamus for a legal directive to DM, Gautam Budh Nagar regarding pursuit of recovery certificate issued by the UP-RERA in favour of the complainant and against the developer. The same is attached herewith as (Annexure 2 to be provided via email).
3. That it is pertinent to above mentioned grounds that such an legitimate orders indicate a clear directive that loan liability is being defined at the end of developer and henceforth DM is responsible to close the account under the guidance o[censored]P-RERA.
4. That due to circumstances arising from such actions the complainant’s financial condition has taken a heavy toll. Pursuing the matter for several years he has suffered monetarily and also gone through unimaginable mental agony of losing money while also not being able to secure his residence. It is pertinent to mention here that due to such handling of the aforementioned loan account, the CIBIL score of the complainant has went way below par barring him from availing any loans, thus further burning through his meagre savings.
5. That the complainant has ailing parents and requires continuous medical care, not to mention his own health that has been deteriorating over time, thus putting him in dire need of financial assistance.
Thus, under these circumstances I write to you to comply the high court order and take cognizance of the above stated matter, also appealing for restoring the CIBIL score of the complainant; at the same time it is being requested to withdraw the proceedings OA no. 765/2018 initiated against the petitioner herein, in the Hon’ble Debt Recovery Tribunal (DRT-II), New Delhi.
