The software development agreement is made on 08/01/2016 between websolz software service pvt ltd, no #25, floor no5, hitechcity-2, gochibowlivilage, hyderabad-500081.India and myself.
On feb 14th 2016, i had to cancelled the project as mr mallikarjunarao pinnamraju, who happens to be the director of websolz, failed to deliver what he had promised.In reply mr mallikarjunarao promised to refund the amount of rs 2, 10, 000 which i had paid as development and hosting services fee by 10th of march 2016.
I have made several attempts to inquire about my refund but mr mallikarjunarao has only lied to me. Twice he mentioned that he had deposited a cheque to my account, but on inquiring with the bank, i got to know that no cheque had been deposited.
As per the agreement i was supposed to receive the refund within 1 month, and now it has been about three months. Mr mallikarjunrao has now blocked my number and has stopped replying to my emails.
A clause from the agreement states as below:
8. Fees and expenses
8.1. Fees. The customer (Pratyush singh) shall pay the developer (Websolz software
Services pvt ltd)
(A) inr 150000 upon signature of this agreement as a down payment for website,
(B) and 150000 inr upon delivery in accordance with the specifications or acceptance.
(C) 60000 for webhosting for 1year dedicated server with 30days money back guarantee if
Customer not like hosting service.
8.2. Payment due date. All fees under this agreement will be due and payable in full to the
Developer no later than 2 days after the date of the developer's invoice.
8.3 refund: 100% fees refund within 1 month, if developer fails to perform its obligations.
It is a shame that people like mr mallikarjunrao bring such bad name to the industry.
Through this forum i do not only seek my refund but also urge people who seek any kind of service to do thorough due diligence before making any kind of pre-project payment to the service provider.
I would also attach the copy of agreement and invoice, if required.
