Sub:-Request to consider objections concerning Electoral-Rolls for the year 2015 in accordance with the CSITA Constitution-Reg.
Ref:-Our representation dated:[protected].
We, the CSI Church members of Armoor once again hereby bring the objections raised in our representation cited in the reference objecting the condidature of 11 members of csi Church from their participating into elections to be held before 1) The Presbytary-in-charge, Armoor 2) Vice-Chairman Medak Diocese 3) Medak Diosesan Ministerial Secretary 4) Property Secretary and 5)Rev Bhasker requesting not to allow the said 11 members for the reasons as follow;
Objections against G.Prabhu Kiran;
i. Mr. G.Prabhu Kiran has filed cases (i) O.A.No: Before the Hon’ble High Court in Madras (ii) E.A.No:17/12 Before the Hon’ble District Judge, Nizamabad, to claim Rs.4.23 Crores without having GPA from the Synod. We learnt that the cases were withdrawn by Prabu kiran, so his name is taken to consideration back into the electoral list. But the fact is he violated the norms laid in the Church constitution. It was not the only objection to object his candidature, but also the following are the few objections basing on which we object his participation into elctions conducted in Armoor Pastorate.
ii. He also tried to grab the compensatory amount Rs.5, 00, 00, 000/- (five crore) issued by the Government against the sale of CSITA Land to Rajaramnagar Colony at Armoor and flee from India permanently, but it was contested in the District Court at Nizamabad and diverted safely into CSI account at Medak.
iii. Mr.Prabhu Kiran Kumar S/o Moses claims that he & his group had purchased the lands in survey.no’s: 1) 494, 495/1, and 2) 495/1 altogether 10 acres from CSITA and fraudulently fabricated, un-approved, un-authenticated forged lay-out documents for survey.No: 1) 494, 495/1, and 2) 495/1 in CSI Trust Association Lands-Medak Diocese at Armoor, Nizamabad and forged some link documents to show that the lands were sold on his name and also on his family members names and on few of his group namely Navaneeth Raj, Faheem, Surya Prakash the principal of HPD School at Armoor and etc by CSITA and getting them registered by way of selling the lands to individuals. The fact is that the either CSITA or any other Trust never ever sell the land to any individual for development purpose, the details of encroached lands are scribed below for persual and record.
iv. He also has encroached and sold out the CSITA land at Elkatoor completely nearabout 20 acres of CSITA Lands, Balkonda mandal the issue in concern with Elkatoor land will be taken to the notice of Balkonda Tasildhar & to the notice of Sub-Registrar in a near future.
v. Further, Mr.Prabhu Kiran Kumar and his group also mined the boulders for gravel, sized stones and also the crust of the hillock located in survey.no: 495/1 and sold out to private parties.
vi. In recent present, Mr Prabhu kiran kumar has sold out few lands in survey no: 495/1 and the construction works are also taken up in a high speed, already 2 houses constructed and the third one is almost at its completion, if the Attorney for CSITA at Chennai fails to initiate action, the trust will lose huge costly properties at Armoor & Elkatoor. To prove the above scribed objections, we request the Moderator CSITA at Chennai through the Presbyter-in-Charge to provide few documents like 1) all the sale considerations approved by the CSITA Body at Chennai & Attorney at Medak Diocese in CSITA lands at Armoor, Nizamabad, telangana, India. Since the source documents are un-available to us 2) the letter of suspension of appointed attorney at Medak-Diocese 3) All letters in connection with General power of attorney issued by the CSITA at Chennai to the attorney body at Medak Diocese. We also request the Hon’ble Moderator at Chennai cum the Bishop for Medak Diocese to initiate legal proceedings against the said people or permit us to file legal proceedings.
vii. Mr.G.Prabhu Kiran Kumar has also encroached near about 1000 yards and running a Cement Brick manufacturing unit illegally in CSI Trust Association land in survey no, 495/1.
viii. Mr.G.Prabhu Kiran Kumar has illegally made a mining for crust in Hillock located in CSI Trust Association Land in survey No.495/1 and damaging the Trust Lands and property.
ix. Most recently Mr.G.Prabhu Kiran Kumar has illegally encroached and sold out 1 - 2 acre of CSI Trust Association Land for Rs. 70 Lakhs to a person name Mr. Anil Kumar the son-in-law of expelled pastor from zion based fellowship from him it was transfered to S.C community(non Christian) to construct a community Hall in the CSI Trust land. And Mr. Anil Kumar has sold to a S.C community(Non-Christians) and now the S.C. community is planning to construct a community Hall in CSITA land in survey no: 495/1.
x. Most recently Mr.G.Prabhu Kiran Kumar has illegally sold out a piece of land to a un-known person from Kamareddy by name ATYALA SANDHYA KUMARI ANANDHA for 5 - 10 lakhs and helped him construct a house illegally by way of forged documents.
xi. Mr.G.Prabhu Kiran Kumar also has sold out the healthly running Wesely School at Armoor to a private party by way of encroaching and sold out 6.4 acres of land adjacent to main road to a private party from CSI Trust Association Land at Armoor, basing on a letterNo: TA/19/250/04 dated: 13th September, 2004 which allows to sell 2.01 acres of land in survey no: 425/1, 425/2, 425/3 but Mr. Prabhu Kiran Kumar has sold out the adjacent land in survey No: 425/2, and 425/3 in total 6.4 acres of land for about 2 crores by then and shown Rs. 60, 00, 000/- on paper, by obstructing and stopping a healthily running wesely school. By no way the sale made to private party for a non christian stands valid.
At this juncture, Mr.Prabhu Kiran Kumar with an intention to transform all the illegal sales to legality got Registered a New Society by name “Believers Colony Society” to turn all the illegal encroachments and transaction made in connection to legal. But the necessity to Register a new society does not exist, the when Wesley Co-operative Housing Society is very much in existence. We the Church members at Armoor hereby request the Moderator and the entire CSITA body not to consider any sale of CSITA Land at Armoor until the issue of fradulence is inquired and concluded.
Objections against G.Nirmal Hrudaya Kumari;
xii. She was elected and acted as a Treasurer during 2002 to 2007 for Armoor CSI Pastorate Committee, during her entire tenure has not revealed any account in connection with 1) offerings/donations given for construction of New Church Building in the form of Cheques/D.Ds/Cash 2) amount sanctioned by Diocese for construction of New Church building at Armoor, in this regard an inquiry commission was also appointed but findings of the inquiry commission was not revealed/declared to the Church as on this date. We the church members of the CSI at Armoor request the Hon’ble Moderator-cum-incharge Bishop of Medak to reveal the findings of the inquiry commission appoointed in this connection. Or else appoint one more inquiry commission to find out the facts if the commission appointed earlier failed to reach to find the facts.
Objection against G.Navneeth Raj;
xiii. He was nominated by G.Nirmal Hrudaya Kumari out of her personal will, without the concern of the church and without following Church constitution as supervisor/ex-officio Treasurer to maintain New Church Construction from 2007 to 2010, during his entire tenure like G.Nirmal Hrudaya Kumari, has not deposited any single pie of Church collections into Church account and used the total offerings to his personal use and benefit, the inquiry commission was also appointed, but the findings of inquiry commission was not revealed/declared to the church as on todate
xiv. Mr.Navaneeth Raj has also encroached huge some of CSITA lands in survey no’s: 494, 495/1 and 495/1 by picturising that he has purchased land directly from the CSITA Chennai in collusion with Mr. Prabhu Kiran Kumar and selling out by creating forged documents the facts will be brought to your authority along with documentary evidences on supplying the details of sale considerations approved by CSITA at Chennai in concern to the lands of CSITA at Armoor.
Objections against Satya Ramesh;
xv. He also at some occasion in the Sunday service has made an announcement to donate Rs.50, 000/-(Fifty Thousand) in the year but till this date the said promise is un-fulfilled, such announcements was made with a malafide intention to expose his riches and to popularize himself among the Church Members by making false promises. This is an obvious abuse of Sanctity of the Church. Hence he is liable to put out of the electoral roll.
xvi. He mined the hard earth crust from the hillock situated in the CSITA lands for his house construction without seeking the permissions of the Church and caused loss to CSITA property. The evidence is partially mined hillock in survey no:495/1.
xvii. He also used some ventilaters of the Newly Constructing Church to his house construction without the permission of the Church and caused loss to Church property.
Objections against D.Surya Prakash;
xviii. Mr. Surya Prakash, the Principal, Henry Penry Devis School, at Armoor, Nizamabad, of Telangana state in Medak Diocese, has encroached few lands of CSITA at Armoor in survey.no:494, 495/1 and 495/1 and selling out to private parties, and he also has constructed a house in the encroached land in about 350 yards in CSI Trust Association Land in survey No: 495/1 and gave on rent.
Objections against I.Devamamda, ’
xix. Mr.I Devanandam has encroached in collussion with Nayeeni Janardhan 1500 CSITA Land in survey.no: 494, 495/1 by forging a link document 1801, 625/1963
Further, all the 11 members once again committed an offence by getting issued legal notices beyond CSI constitution perview and thereby once again lost an opportunity to contest in the elections to be held for Armoor CSI Pastorate by making an act & deed against CSI Constitution. We also request the Presibytary-in-charge & the ministrial custodians to accept & consider candidates nominations only on production of B.C-C/Christian/Concerted Christian certificates and not to entertain the candidates who do not possess christain certificates as specified in CSI constitution.
The said representation dated:[protected] which was made before the above said 5 ministerial custodians was leaked over to the said members and they visited the houses of every individual who appended signatures objecting their candidature and issued dire threats and intimidations warning to kill every one and burnt away the houses and make them into ashes of the persons who signed the representation. In our representation, we also made an option to them to prove their innocence before the church if the objections raised by us are not genunine. Instead they are creating internal disputes among the church members and to frieghten us they got issued Legal notices through an advocate a legal executive out of non CSI Government, for making a representation before the CSI ministerail custodians, warning us to prove the allegations within 10 days or else they will file criminal & civil cases upon the persons who appended signatures in the representation, particularly upon the church members who obtained& performing jobs seeking their original caste and obstructing the Church growth directly. And thus once again the said 11 members did an Act against the CSI Constitution and spoiled the chastity of CSI Constitution, and thus by issuing legal notices by an advocate who is out of CSI Constitution’s perview, there by humiliating the constitution lost an opportunity once again to contest in the election to be held for CSI Armoor Pastorate in the near future, this may be noted and implemented strictly to safeguard the church members faith in the CSI Constitution.
In actual, the objections made by us in our representation ought to be verified by your Hon’ble custodians in confidential and decide the genuinity of the objections made in the representation and ought to have called for inquiry and the persons upon whom objectons have appeared/approached before the ministerial custodians in faith of CSI constitutions as the representation made in accordance with the CSI constitution to sort out the objections against them, instead, they are frieghtening the church members by issuing above said threats and getting the legal notices issued and warning to drag the church members to implicate them into criminal and civil cases. And thus spoiling the chastity of the CSI constitution. Kindly conduct an inquiry on our representation at the earliest possible to judge the eligibility as per CSI Constitution. Those 11 members may not have faith in the ministrial custodians and the CSI constitution, due to which they have approached an advocate who is out of CSI’s perview and committed another blunder and lost eligibility to have their names in the electoral list.
Further, we also request an explanation from your authority that 1) from whom of the 5 ministrial custodians before who we made our representation which ought to be dealt confidentially was leaked the hard copy to the objected candidates due to which entire church compound is turning to flames and it may turn to ashesh in the near future if immediate action is not initiated. 2) also furnish explanation for not declaring the final report of the committee appointed to inquiry into mis-use of New Church Construction Fund and the inquiry into non-accountability of offerings made in the church for a period specified in our representation. The report may be declared with immediate effect to bring the raised disputes/clashesh to calm down.
We also are scared of to make further representation before your ministirials custodians with a fear of the said 11 members. We bring to your notice that they may kill us for making representations for justice before you, we have death threat from them, they may burn our houses and bodies into ashesh as they have warned us by visiting individual houses.
Further, when we approached the Presbyter-in-charge Mr.Prem Kumar garu to know as to how the representation made by us was leaked to them, he did not show any interest into our request and behaved rudely, when we said that we will take the matter to the presence of Hon’ble Moderator garu, on hearing this, the responsible Presbytary-in-charge used filthy words like”NENU DCC CHAIRMAN NI, NANNU E MODERATOR EMI PIKALEDU”, “MEERU COURT KI VELLANDI NA DAGGARIKI ENDUKU VACCHARU” and such many filthy words. We think that our Presbytary-in-charge also is humiliating the CSI Constitution. We also dooubt on the presbyter-in-charge of Armoor from whom the matter and the hard copy of our representation would have leaked to the objected member to provoke disputes, since he always supports out of most concern for them from the point he has assumed his charge as presbytor-in-charge at Armoor. We also have objection upon Rev.Prem Kumar on continuation of his duties as presbytory-in-charge at Armoor, kindly transfer him from Armoor with immediate effect without any further delay to bring peace among the church members.
Further, the said 11 members made another attempt against the CSI constitution, by getting issued legal notices against the members who approached the CSI ministerial custodians for justice, having no faith in it, when they do not have faith in CSI constitution, they also loose the right to continue under it. This is an offence as per CSI constitution.
Therefore we request the ministrial custodians to conduct thorough inquiry into our representation dated:[protected] and also on the legal notices(copy enclosed) issued through an advocate who is out of CSI constitutions’s perview, and cancel the elections until the said 11 members names are removed from the electoral list for the act & deeds made by them against CSI Constitution. We only want elections only when the said 11 members names are removed from the list until then we pray the ministrial custodians to cancel the elections.
Further, we request your authority to supply 1) the by-law copies of CSITA to all the interested members of our church on payment if need be, most urgently, 2) the final committee report appointed to seek the accountability of New Church Construction fund and the accountability offerings collected in the church during specified period in our representation, at the earliest possible.
