Car Parking — Registered Car Parking

Dear Sir/Mam

My father has bought a flat, with a registerd parking bought from the builder, in Sector 19, New Panvel, navi- Mumbai, Maharashtra. four years ago. The flat was vacent till May 2009. The society is yet proposed. Now, in the society meeting members said that a builder/developer can not sell a car parking to any one as it comes under the society.

One of the member further commented that a builder can sell the parking only when there is adequate parking for all the members in the building. Total number of parkings are four against ten flats in the building.

They indirectly were threatening me for legal action, though we have shown them the original sales deed. When my father spoke to the builder he told him that he is eligible to sell parking.

Please guide me whether a developer can sell parking in a building or not and if he can, then under what conditions?

What steps shall we take if my father's action of buying the parking from builder registered in his name is correct?
