Sub: Demand Notice – SBI Card No[protected]

I am receiving legal notice from SBI card for non clearance of dues. I would like to say that I have cleared all my settlement with SBI card.

I have made the payment to SBI card as per the settlement letter issued by SBI card Tracker No MUMINDBHP[protected] dated 09/08/2008.

Chq no 338826 of ICICI Bank for Rs 2080 is cleared from my bank a/c and credited the amt to SBI card.

In letter issued by SBI, it was clearly mentioned that once the payment of Rs 2080 is cleared from my side there will be no outstanding in my account no[protected].

Inspite of clearing all dues as per the settlement letter, Still i m getting legal notice from SBI card.

Kindly go through my settlement file and please insure that such Demand Notice should not come to me in future.

This is the second notice I have received after clearing my settlement with SBI, this leads to lot of confusions and it also waste the valuable time of yours and mine.

Please make a note of this.

Please excuse me for I would like to draw your kind attention for going through a few lines and may be for spoiling your valuable time. I am writing this thinking that this is the right forum to address my problem. I am also herewith reposing a lot of hope that you would be able to lift me out of the trap of SBI Credit Card.

I was holding an SBI credit card(Card No.:[protected]) since 2006 and my uncontested transaction with them was till 9th May 2008.

I also received a intimation letter from SBI card vide ref. no.:MQ[protected] dated May 10, 2008 closure of the card for usage and was also advised to destroy the card to avoid any misuse. I did exactly the same, the card was destroyed and closed the horrendous chapter was believed to be closed.

Suddenly, one fine morning on 03.06.2008, 11:30 am I got an SMS (Your statement Dt 01-JUN-08 has been dispatched. Total O/s of Rs.548.82 or Min of Rs268.64 is Payable by 21-JUN-08-SBI Card). At this point of time I started smelling decomposed rat but paid the amount of Rs.549/-(Rupees five four nine only) to avoid dragging the things further by putting a cheque in the drop box vide cheque no.635666, SBI, Guwahati and was debited duly from my a/c .

After that everything went peacefully and I also started forgetting the brunt of losses I already suffered through this Credit Card. Suddenly one day in April 2009, I got a demand notice from SBI card that I had to pay Rs.7720/-(Rupees seven thousands seven hundred and twenty only) reason being they did not deposit the cheque issued by me vide cheque no.820186 SBI, Guwahati dated 07.04.2007.

The cheque was collected by one certain Ramen through an agency called SMD and acknowledged vide Book No.: 153343(Receipt no.: 7667142) dated 07.04.2009.

Now, what I believe is that the cheque was not deposited intentionally to trap and entangle the card holder(me) for an infinite period for exploiting money. It is also possible that the cheque was held up with the Agent itself but the amount was levied with all other hidden charges through the subsequent transactions till 9th may 2008.

Lastly, I have received one letter through them vide Ref. Code:NXD August 01, 2009 stating that I have to pay Rs.8399.75(Total outstanding as escalated from Rs.7720/-) or a minimum of Rs.866.29 or else face a legal action for recovery of the outstanding with other charges.

This has become too much for me to swallow and digest and hence to repute the charge, I sent an e-mail to head.[protected]@ge.com for Shri Ajay Bharti, Ast Vice President, Customer Services, PO Bag No.28, GPO, New Delhi-110001 demanding a certain explanations like:
I. What is the proof that and amount of Rs. 7720/-(amount o[censored]ncleared cheque) was not levied through the subsequent transactions? Also tell me why the cheque was not deposited by you in time(This I believe is intentional to put the consumers in trap )?Why the cheque is not handed over to me yet? This I believe is intentional to put the consumers in trap
II. To furnish the full transaction detail since inception
III. Why I had to pay extra Rs.549/-(Rupees five hundred and forty nine only) after clearing the payment of Rs. 79177/-(Rupees seventy nine thousands one hundred seventy seven only)?
IV. Why stern action was mot taken against your staff/agent for whose fault I am facing this problem?
V. Why the O/S has escalated from Rs.7720/- to Rs.8399.75?
However reply from the gentleman is awaited.Anyway they have asked for three days time to reply. It is absolutely fine with me.

However isn’t it illegal that SBI card is putting a claim?
