the supertech Limited booked the flats for its eco village project in the march 2010 at the 10% of the basic price and issued allotment letter and agreement and send the next demand containing the condition of 2% per month in case of delay payments of its dues.In the May 2011 the aforesaid project was stopped due to some disputes and courts cases.
The supertech Limited did not ask for the its dues in the mean time and I have received a letter dated 15.02.2012 on 09.03.2012 wherein i was informed that my booked flat have been cancelled on the ground of not making the payment of 10% of the total cost although the supertech Limited accepted my booking at the basic price and gave me allotment letter and aggrement.I further inform that no notice of such short payment was issued prior to this cancellation letter.
I further inform that the supertech Limited issued the letter of cancellation to many buyers without giving them any prior notice who paid the amount of basic price on the ground of not receiving payment 10% of the total cost of flat. Its really disappointing and surprising that supertech Ltd who claims his reputation in the market is cheating with his buyers.
supertech limited remain silent for 2 years and suddenly send the letter of cancellation. This has been done because market price have been increased and the greed factor has come in the mind of the company throw is old buyers and sell the flat at high price to new buyers. This is a clear cut that the supertech is cheater and has no character and reputaion in the market. such a builder should hanged like any thing who cheats the masses. We don't agree with your statement as the criteria for a confirmed booking is 10% of the Total Flat Cost and the same is already been mentioned in all our price list and allotment letter too. Hence in compliance to this 10% has to be paid, so whomsoever has not qualified our criteria for booking, we are unable to continue their booking with us.
Moreover we would like to quote from the official company press release on this subject - "Developers, meanwhile, say that cancellation letters have been issued only to those who have not paid as per conditions of the sale agreement. "We issued cancellation letters only to those who booked flats by paying a part of the booking amount, " said RK Arora, MD of Supertech. "Moreover, buyers who defaulted on payments before the land row broke out have been issued cancellation letters. We sent regular reminders to them and records have been maintained. Cancellation letters have not been issued to any customer whose payment is up-to-date and has been made as per the terms and conditions, " said Arora."
* Note : To inform you, who have paid the substantial amount, we are considering their case forward.
We completely deny your statement - "market price have been increased and the greed factor has come in the mind of the company throw is old buyers and sell the flat at high price to new buyers" - As the grounds for cancellation was never routed through this else the company would have cancelled all the units with this gesture, however as already mentioned in our above statement we have considered all cases who have paid the substantial amount.
