[Resolved] Unitech — Delay in construction

Dear Sir, I booked an apartment in Unitech Verve, Greater Noida in Dec 05, with possession promised in Dec 08. The project is still not ready with management now estimating June 2010 as the possession date. Unitech is taking its customers for granted without realising that people have invested their hard earned money in this project. This is simply ridiculous and strict action must be taken against the company. Unitech management is down playing the entire situation by saying that they will compensate the customer with INR 5/ sq.ft as damages, which works out to a penal interest of just 2% p.a. on the property cost of INR 3000/sq.ft. Whereas, if the customer defaults on payment, the penal interest is a staggering 18%. Is not the difference staggering !! Complaint marked as Resolved Verified Support Jan 15, 2014 L'solutions Customer Care's response Dear Sir, I represent Legalistic Solutions Private Limited, a legal consultancy firm in Noida; that represents numerous clients in such matters of subvention scheme fraud. We are currently handling several subvention fraud cases against the developer, where the buyers were not granted possession on time. Many of our clients had planned their expenses in accordance with the promises of property possession made by the developer. Due to the delay in completion of the project those clients are now forced to bear additional expenses as they are paying EMIs along with rent expenses for their current residences. We are about to initiate negotiations with the developer and are contemplating our options. We have come up with the following alternatives- 1) Complete refund of the entire amount paid to the developer, from the bank as well as initial down payment made by the buyer, along with interest. 2) Allotment of property of similar value to the clients (assuming possession is immediately available). As of now we have close to a dozen clients who have been duped by the subvention fraud and we would like to invite more complainants to join us in our effort to get compensation for our losses. The more complainants we have, the more pressure we can build upon the developer. Only by uniting can we force the large corporation to sit at the negotiating table. Dear Sir,

I think it is time to take strict action agains UNITECH for delaying the launch of the Cascades project in Greater Noida. I think they are taking their customers for granted. Do they realize that people have invested their hard earned money? Moreover, it seems that they are planning to charge escalated maintenance charges at the time of possession. This is simply ridiculous and strict action must be taken against the company. How about paying us a penalty at 10% Per Annum on the amount paid so far? How about revising the Rs 5/- psf penalty for delay to Rs 10/- psf?

Guys wake up or it will be too late!

Unitech Group — Unitech Verve Possession is very late

Unitech is not building from 2007.And there is No Registery till Now. So we need to be united against Unitech Verve Builders.

Can someone help me- I have taken a home loan from ICICI for Unitech Capella[Stupid me] for the esteemed project[ha] Unitech Capella in greater noida. I believe the project hasn't taken off.I continue to pay ICICI Rs50000 a month.What is the best possible way out for a sucker[NRI] like me.

I cant belive you did that. Capella is a complete non-starter like many other unitech projects. Nevertheless they will do 'one day' ...you should be getting it in 2012 or thereabouts as Unitech is already working on arranging funds and reducing their debt from 2 Billion USD to 1.5 now in 2 years time. With that rate they should be having positive cash flow in 3 years time and thats when they will start building it.

I had booked a 2BHK in Capella. As the project is a non-starter lets try to contact other allottees and put pressure on Unitech. They are selling projects in other areas like Noida n Gurgaon. These projects I believe will be constructed earlier than Capella(if it happens). We cud ask us to be shifted to some other suitable project.

I complete agree that Capella is a non-starter. I have fallen for the same trap by booking a 2BHK (albiet my EMIs haven't started yet, being under the 30 months zero EMI scheme, I hoped to cash in on the real estate boom but duh!!). Unitech had done some initial excavation (probably during the launch of the project, 2 years back) and stopped everything after that. Even the Unitech Noida customer support is not ready to commit, when or if at all they are Unitch is going to start any work.
Regarding shifting to other projects (in greater noida/gurgaon or anywhere else), I had checked this Unitech and they do not have any such options.
We need to get together (all Capella owners) and start looking for options to counter Unitech. Do get in touch with me through email.

I have also bought a flat in Capella and I am in touch with Unitech. I have also visited the site and I got to know that Unitech is planning to restructure this project just like the way they are doing it for Grande. Unitech mgt has told me that they would be providing value proposition options. Not sure what they are.. I think we need to form a group and put pressure on Unitech to either return the money back with interest or provide other meaningful options. I am in need of company to take this dialogue forward... Hi All,

I get to know from this forum that there are others like me who have been trapped by Unitech- Capella at Greater Noida. I have also booked the flat, got a NRI loan from an Indian Bank and paying Rs.45, 000 per month as EMI without there being any update from Unitech whatsoever. I also do not get any update from Unitech, whatsoever. Unitech should either return back the money that we paid them with interest or commit on a time period to give us the allotted apartments.

I am eager to join any forum in this regards and ensure that all o[censored]s get what we have paid for at the right value...I understand that they have mentioned 40 months in the SPA (Sale Purchase Agreement) from the time of signing the Agreement and they will be paying the allottee a penalty after that.

I am with you guys. I also booked 3BHK in capella and no idea when it will finish. Please form a group and start putting pressure very soon other wise they won't take seriouslly. It is 100 acre Porject and capella is all together 12 Acres only. They have not started the booking for any other projects, means they are not sure about the future of Project. At least we can put pressure and get back the booking amount or what ever money we have paid till now.

2. On the top of the google groups window, Type, unitech-capella-owners and click search
3. You will see the group as the first link in the search... Click on the link.
4. Click on "Sign in and apply for membership"
5. Log in to your google account (If you do not have one, you need to create a new account) and apply for group membership...

I have also booked capella apartment in 2008 under subvention scheme. I have contacted UNITECH people so many times but they dont have any answer.

I THINK WE SHOULD DO A COMBINED CUSTOMER COMPLAINT IN CONSUMER COURT AND TAKE OUR DUES BACK FROM UNITECH. I AM READY TO TAKE THE INITIATIVE.

PLS CONTACT ME at [protected] and we shall start the proceedings in consumer court. MORE PEOPLE, THE BETTER.

WE ALL CAN SHARE THE COST ALSO AND IMPACT WILL BE GREAT IF MORE PEOPLE CAN JOIN IN COMPLAINT.

Here are some recently published article about Unitech. I'm also one of the victim o[censored]nitech. I have bought a flat in Nov2007; however, they have not laid a single brick on the project. Moreover. they have changed the format of the project wihout notifying their customers.
Now decision is yours if you want to be same dilemma after two years.

We booked an apartment with Unitech heights in July 2008 with the possession promised in May 2008. It is alredy Oct 2008 and till now there is no news on when the project will be completed. We paid a premium just for the brand name thinking that they'll honour the dates.

Can the concerned authorities look into the matter and take appropriate action?
