Hi,
I brought Step up herbal body growth formula from GTM (Global Tele Mall) Teleshopping Pvt. Ltd. after watching their advertisement on television. They stated that “It was an herbal body growth formula and would help in increasing physical height of any person of any age group [Preferably up to 45 Years of age]. They also claimed that if the product doesn’t work within 30 days, they would refund 110% of the money back to the consumer”.
I am 29years old and wanted to try it. I brought the product and received the shipment on 10th Jan 2013. I received the product shipped in 3 plastic containers and have used it until 7th Feb 2013 [Finished using 2 containers completely] as per their instructions, however the product failed to have any effect and I did not see any result as promised by the company. I called their customer service line [Phone No. 0-[protected]] on 7th Feb and spoke to one of their Customer Service Rep and explained the issue to him and asked him to guide me with the steps to return the product and demanded a refund for the same. He initially insisted that I try using the product completely since it was linked to hormones, it would take extra time to show results on some people, which by the way is contradicts what they claim in their marketing message. I then asked him if it still doesn’t work, will they refund my money. He said that it was a value back guarantee and not money back guarantee [which essentially means that if the product doesn’t work they would substitute it with another product offered by their company worth the same amount], this again is a contradiction of what they claim in their marketing message; and it only applies for 30days and I would not qualify for refund if it didn’t work. I therefore declined his recommendation and asked for refund. He then started throwing the following options at me:-
1. He will consider my complaint and issue another shipment of the same product to try, however without any Guarantee/Warranty this time.
2. I can buy a different product from them which is worth the same price [Rs. 3000]
While I declined the above and insisted that they refund my money, he said that they will pay Rs. 3,300/- to me over a period of one year in 12 monthly installments. I requested that they refund my money in a single full payment, for which he said that it was their company policy which cannot be changed and hence won’t be able to help me. He said that if I needed a single payment, they would deduct Rs. 750/- towards shipping charges and refund Rs. 2,250/- within a week. I declined for both their refund options and then insisted that they refund my full amount in a single settlement and within a week. He said that it won’t be possible. I then told him that I would be lodging a complaint with the Consumer Forum to fight this issue legally and he said that I was welcomed to do that, hence writing my grievance here to get justice. PLEASE HELP!
