Sir / Madam,
I Manoj Mitra, being owner of a Premises Plot No : 8567, Mouza Ranaghat, J.L No : 155, Police Station Ranaghat, Dist – Nadia, Pin -741201 ( Double storied Pucca building with the Marble floor ), which has been acquired by the National Highways, under the National highways Act 1956 .
Acquired area 0.016 acres, class of land Dokan with residential structure .
In reference to the matter stated above that unfortunately the measurement of the building has not been done properly till date . The national Highway Authority served a Notice for re verification of structure on dated 23/10/2019 but verification of the same not been done. The National Highway Authority served a notice for demolition of structure over the disputed plot, accordingly I filed an injunction application before the Ld District Judge and ultimately the Ld District Judge by an order No: 09 dated 14.11.2019 in the Misc case No ( Arbi 53/2018 ) passed an order as follows :
“ It appears from the notice served upon the petitioner, The NHAI authority has informed him that a suitable date for re-verification of the structure be intimated but no such date has been fixed and NHAI authority is going to demolish the structure . Thus the injunction application was filed, It is true that the compensation for the structure has already been paid to the petitioner and Arbitral Award has also been received by the petitioner, The NHAI authority has already been taken the responsibility for the re-verification of the structure of the petitioner . So, It can be assumed that the petitioner for demolishing the structure, They would re-verify the same and it is appears to them that the area of structure is more than the assessment as had already been assessed during the calculation of compensation, they will must pay the excess amount of compensation to the petitioner .”
A copy of said order and The National highway’s re verification letter are enclosed and marked with .’ “ ‘
That is view of the aforesaid order passed by the competent court of law still The Authority of national Highway and side by side the competent authority of District collectorate does not take any action or does not served any letter to me against on the order of Ld District Judge for re verification of my structure and land . Moreover simultaneously forcefully they are sending some unknown person with JCB and Dozer machines in between my residential premises for the purpose of demolition my pucca double storied residential building and trying to make me to go outside from my residence forcefully in between this pandemic situation . They are mentally assaulted me also .
Hence, As a senior ctizen having cyber heart disease with high blood pressure at age of 69 years I am feeling mental torture and tension by their activity in my daily life .
As an octogenarian petitioner I am enclosing my medical paper also .
Moreover as per L.R or B.L.R.O record my total property area is 0.035 acres with class of land, Dokan and double storied marble finished residential structure but The National Highway authority and Competent District collectoate trying to capture my 0.01 acre land without any proper written notice or L.R record by giving mental pressure and stress and also trying to create mental retardation on me .
Not only that in view of this connection different type of peoples whose are claiming themselves as an employee of National Highway and Dist collectorate forcefully entering my premises without any Identification card and doing different type of demarcation on different date on my Registered property without issuing any letter or written paper simultaneously they are doing all verbal communication instead of issuing any written letter .
Under the circumtances, As an octogenarian citizen I am requesting you to help me out from this problem .
So far I am living on this property from more than 40 years with proper document and B.L.R.O Registration and paying all type of Government taxes since last 40 Years. So, you are requested kindly send proper or Higher authority for re verification before any acquisition of my property . Moreover I have a full support for an expansion of National Highway but proper compensation and proper demarcation expected from competent Authority as per the rules of Government regarding Land acquisition.
I awaiting your reply and fruitful action against this brutal activities.
