In this scenario, Deepak Dinesh Kapadnis enrolled in a course offered by the Opposite Party, SKILL-LYNC, called "Post Graduate Program in Hybrid Electric Vehicle Design and Analysis" on July 9, 2022. The Opposite Party had informed him that the course fees would be 10000 per month, but did not disclose the additional cost of a loan. Once the admission process was completed, the Opposite Party informed him of the loan and its associated EMIs.
Deepak, belonging to a poor middle class family and being an educated unemployed person, requested for the cancellation of the course and loan as he was unable to afford the 10000 EMIs per month. However, the Opposite Party refused to cancel the course and refund the fees citing their non-refund policy. The situation caused significant distress for Deepak and the loan company also began to harass him.
On October 10, 2022, the Opposite Party sent Deepak Dinesh Kapadnis a letter o[censored]ndertaking stating that they would cancel the course and that Deepak would have to sign certain conditions. Deepak agreed and signed the document. However, after three months, the Opposite Party informed Deepak that the loan cancellation was still in process. On January 2, 2023, a representative from the Opposite Party called Deepak and informed him that the course would not be cancelled and that he would have to continue with the course.
