In the year 2002, I purchased a flat from promoter taking the loan from SBI. The price of the flat was Rs. 6 lacs in which I gave cash of Rs 1.5 lacs and bank loan of Rs. 4 lacs and balance Rs. 50, 000 was due. After purchasing the flat I entered there and began to recover the loan.But soon the promoter and his friend forced me to give interest for that due amount in cash of Rs. 3000 per month. I gave the interest for 9 months. In the meantime, I got transferred to Kharagpur office. So I could not recover the loan regularly. After giving interest for 9 months I stopped to give interest. Then the promoter began to assault me in various ways. Thus residing at the flat for 2 years, the bank and the promoter bound me to leave the flat without any court order taking the key of the flat. I had paid about Rs. 50, 000 of the loan in the bank till then.
In 2007, the bank manager contacted me again and asked me to deposit E.M.I. through my office. I prayed permission to my office and began to deposit the E.M.I. by cheque from my office. The Asst. General Manager of the bank told me that he will give me the key of the flat after depositing one month's cheque and show him the receipt. But after that he called the promoter and after some discussions between them, he refused me to give the key asking me to register the flat. But at that time, I was not ready to give the promoter the due money and revenue the registration. I requested several time but all in vain. I had paid about Rs. 1, 60, 000 of the loan in the bank through office cheque that time. So all together around Rs. 2 lacs was paid to the bank out of Rs. 4 lacs loan. But I hadn't get the key to enter the flat.
Now I came to know from the promoter that the flat has been resold by the bank and the promoter without any of my knowledge. The present valuation of the flat is minimum Rs. 25 lacs. But I haven't got any part of the sold amount neither from the bank nor from the promoter. They have cheated me and shared the money between themselves. Was this information helpful? |
