I had booked a 2 BHK flat in project Eco Village-3 situated at GH- 06, Sec- 16-B Greater Noida 201303. Pursuing to the Terms & Conditions of the agreement, I had already made timely payment amounting to Rs. 2474064.96 till date. The possession of the unit was supposed to be given by Dec’17 with a further grace period of 6 months i.e. by Jun’18. However, the fact remains that excavation work upto foundation that too for part of the area has been carried out by the Company after almost 6 years from the date of the said agreement.
The company has never informed me regarding the delays and rather was sending arbitrary photographs of the progress to secure the payments of instalments from me. After making the last payment in 2016, I have not received any further communication from the Company and have no idea as to when I will get the possession of the unit or will it ever happen.
The actions on part of the Company tantamounts to fraudulent practices, deficiency in services and breach of the Builder Buyer agreement. The Company has wilfully failed to offer timely possession of the unit within the contractual period or within a reasonable extended period. It was incumbent on part of the Company to communicate and pass on necessary relief by way of refunding the deposited amount along with applicable interest or to allot an equivalent unit at any of its completed projects in NCR/Noida. However, the Company has miserably failed to initiate any alternate measure and has driven me to unbearable financial hardships. Can anyone help me with the way forward?
